 Over 25 million cubic metres of excess soil generated annually in Ontario

  • Approximately 1.6 million truckloads per year
  • Costly to transport and disposal ($, greenhouse emissions,

traffic congestion, roadway wear and tear)

  • Sustainable excess soil management and reuse

 Current applicable regulations:

  • O.Reg. 153/04: Record of Site Condition
  • Table 1 Site Condition Standards used to define “clean fill”
  • Other applicable criteria (Tables 2-9) used to define

“contaminated material”

  • O.Reg. 347: Waste Management

 Key Amendments to O.Reg. 153/04

  • Exceptions for groundwater exceedances relating to drinking

water (e.g. chloroform)

  • Exceptions for road salt exceedances
  • Exceptions for naturally elevated concentrations in soils
  • Redevelopment of religious-gathering and low-rise

commercial buildings uses will no longer require an RSC (with certain exceptions)

  • Multiple horizontal properties (e.g. condominiums) will no

longer require multiple RSCs

  • MOECC indicates changes are almost finalized but will

be made concurrently with Excess Soil Regulation.

 New Excess Soil Management Regulation

  • Defines when excess soil is a waste unless certain

conditions are met

  • Requires an Excess Soil Management Plan prepared by a

QP

  • Exporting more than 2,000 m3
  • If the project area was used for an industrial use or as a garage,

bulk liquid dispensing facility, or dry cleaning

  • Exceptions (with certain conditions) for moving top soil and soil

less than 100 m3

  • A description of past uses of the project area is required (such

as a Phase One Environmental Site Assessment)
