Cont Context and B xt and Bac ackg kground ound • Township of Oro-Medonte Comprehensive Zoning 97-95 (passed in 1997) permits cannabis production and processing facilities in a number of zones, including the Agricultural/Rural and Economic Development Zones. • Council passed Interim Control By-law (ICBL) No. 2018-109 on December 12, 2018 and it has been extended to June 4, 2020. The Interim Control By- Law (ICBL) temporarily prohibits cannabis production and processing facilities on lands in the Agricultural/Rural (A/RU) Zone. • Purpose of ICBL was to permit the Township to undertake the necessary review of its land use planning regulations pertaining to cannabis production and processing facilities related land uses. 2

  3. • On August 14, 2019 Township Council directed staff to Amend Zoning By-law 97- 95 to define and identify “cannabis production and processing facility” as a permitted use in specific zones and establish specific performance standards such as provisions for minimum setbacks from lot lines, minimum separation from sensitive land uses and provisions for matters such as parking and loading standards and minimum landscaped area. • A draft Zoning By-law was prepared containing permissions and provisions for the Agricultural/Rural (A/RU) Zone, Economic Development (ED) Zone and Rural Industrial (IR) Zones and a Public Meeting was held on December 17, 2019. 3

On March 13, 2020 Township Council further directed staff to amend Zoning By-law 97-95 to permit cannabis production and processing facilities as a permitted use in only the Economic Development (ED) Zone and Rural Industrial (IR) Zones. A draft Zoning By-law Amendment has been prepared by Planning Staff for discussion. 4

Key Highlights Draft by-law proposes that cannabis production and processing facilities be permitted only in the following zones: • Rural Industrial (IR) Zone • Economic Development (ED) Zone NEW DEFINITIONS Cannabis means a plant or any part thereof found in or derived from such a plant that belongs to the genus Cannabis.” Cannabis Production and Processing Facility means any building or structure licensed and authorized by Health Canada to ship, deliver, transport, destroy, grow, dry, export and/or import cannabis for medical or non-medical purposes, including related research as defined an applicable Federal Regulation, as amended from time to time. Sensitive Land Use means an existing residential building, existing place of worship building or lands containing or zoned to permit a public or private school, day nursery, public park or community centre. Adding the following sentence at the end of the definition of “Agricultural Use”: “An A gricultural Use does not include a Cannabis Production and Processing Facility or the outdoor growing of C annabis.” Adding the following sentence at the end of the definition of “Agricultural Use, Specialized”: “A Specialized Agricultural Use does not include a Cannabis Production and Processing Facility or the outdoor growing of Cannabis .” A cannabis production and processing facility will be subject to site plan control pursuant to Section 41 of the Planning Act. 6
