  2. HIGHLIGHTS OF THE MEMORANDUM OF AGREEMENT May 26, 2017 • 5 Year Agreement Expiry July 1, 2022 • $1.33 COLA Rolled in upon ratification and soft float rolled in at expiry of 5 years. • 2 Weeks single day vacation entitlement increased from 1 week.

  3. • New Defined Benefit Pension Plan to take effect January 1, 2018 for members that were hired before October 15, 2011, this plan will mirror our current legacy plan which will be frozen as of December 31, 2017. • Defined Contribution Plan Increased to $2.65 from $2.50 including hours for period of Lay-off to a maximum 35 weeks, hours for absence for WSIB and Weekly Indemnity(STD), hours for leave of absence for Maternity/Parental leave at the rate of 40 hours per week, leave for military service per Employment Standards Act (ESA) • After 40 years of credited service you start collecting Defined Contributions (DC) • Legacy Pension $30 million up front, 10 million per year for 5 years and 15 million per year for 15 years

  4. • Weekly Indemnity (Short Term Disability) increased to $805 weekly from $705 weekly. • Weekly Indemnity (Short Term Disability) waiting period is reduced to 5 days from 7 days. • Production Payment Plan (PPP) average to be shared equally across the plant. • Lines of Progression (LOP) creation of a new Stand Alone Crane Box in Cold Mill and a review of all LOP within 6 months jointly between union and company

  5. • Quarterly Expedited Arbitration added to our current Section 9 Grievance procedure. • Letter of Understanding Injured and disabled workers will be paid no less than level 2 • Letter of Understanding (LOU) Permanent Lay-off and Closure of Department Primary Division 18 months notice if Coke Ovens were to close. • Include language for opportunity transfer out of Primary to a new line or new or vacant position elsewhere in the plant. • Letter of Understanding for outstanding Human Rights matters to be reviewed providing the individual agrees.

  7. • Renew all existing letters of understanding (L.O.U’s). • 320 Hours for Union to administer ELHT Trust. • $200 million for OPEB’s over ten years to fund Employee Life Health Trust (ELHT) to pay for Benefits (OPEB’s) for USW 1005 Retirees. • Additional Possible funding for OPEB’s (7.59% of any free cash flow over $200 million per year of the ten year commitment)

  9. The Collective Bargaining Agreement will only become effective upon the execution and delivery of the Stakeholder Agreements listed on Appendix hereto. Such agreements shall be in form and substance satisfactory to the Negotiating Committee of the Local, such satisfaction to be evidenced by their execution and delivery thereof for and on behalf of the Local or by a certificate signed by the Negotiating Committee if the Local is not a party to any such Agreement. This condition may also be waived in whole or in part by the Negotiating Committee of the Local, such waiver to be evidenced by a written waiver signed by the Negotiating Committee.
