  • 1. Product approval: Allow Farmer to Access Innovative Products Faster

The proposed positive list considers only 4 biostimulant microorganisms, but hundreds or even thousands are already on the market or under development. The process for adding new microorganisms slows down innovation significantly and discourages investments in identifying and selecting new microorganisms. If the updating of the list is based on publicly available data, then it will never contain the most innovative products because of the time lag between discoveries and publication of peer-reviewed scientific literature.

  • 2. Parallel Status: Taking into account the specificity of nature’s work tools

Focusing on label claims and functions of specific products. Many components have different uses that are often the function of the application methods, formulations, or use rates.

  • 3. IPR and data confidentiality: Better protection for state-of-the-art innovation

Once microorganisms are included in the positive list, they could be used by anyone. That creates unfair conditions for competition where a company that invests in R&D is forced to share it with companies that have not made the same investment, without fair compensation. This provides a disincentive to innovate. Companies need a pathway to demonstrate that a newly identified and selected microorganism (or consortium) is safe and effective, without undermining existing protections for trade secrets and data confidentiality.
