law prepared under Section 34 of Ontario’s Planning Act.
– Regulates the use of land and the location, character, height and massing of buildings and structures.
- The Zoning By-law is enforced by the
Township:
– To receive a building permit, your project must comply with all applicable provisions of the Zoning By-law.
What is the Purpose of this Project?
- The purpose of the project is to develop a new Comprehensive Zoning By-law for the
Schomberg Urban Area (see map below) as well as the King City Urban Area.
- This meeting is being held to introduce the Draft Urban Areas Zoning By-law. The Draft
By-law is now available on the Township’s website (www.king.ca) for download.

What is the Timeline and Process for this Project?

- Schomberg is currently subject to the
Township’s comprehensive Zoning By-law
- No. 74-53.
- The current Zoning By-law is structured
and functions similarly to other Zoning By- laws in Ontario. It contains:
– Zoning maps that designate all lands into different “zones” (see image at right) – 21 zone categories, each of which is associated with permitted uses and lot and building requirements – There are also General Provisions that are applicable to certain uses or in certain circumstances – There are Definitions to assist in interpreting the Zoning By-law

Zoning By-law is based on the Nobleton Urban Areas Zoning By-law, utilizing the many improvements made through that process.

(Schedules A and B) form part of the by-law. These maps illustrate the zoning and application of some special provisions.

- The By-law is prefaced by a section entitled “How to Use
the By-law” that describes how a person can look up the zoning for a specific property.
- Part 1 contain
ins the Admin inistratio ion Provis isions.
– This section describes how to the read and interpret the by-law. – This section outlines the penalties for contravening the By-law.
- Part 2 contains the Definitions.

– Definitions are critical for interpreting the by-law. – Compared with By-law 74-53, many improvements have been made to this section, with some unnecessary definitions deleted, some definitions consolidated, and new definitions added to ensure clarity. – The definitions are conveniently prefaced by an index. – Some definitions are associated with illustrations to assist in their interpretation.

What does the proposed zoning for Schomberg look like (3 of 8)?
- Part 3 contains General Provisions.
– The General Provisions apply to all zones, but they are usually only applicable in certain circumstances. For example, provisions for Home Occupations will
- nly apply to a proposed Home Occupation use.
– Many new General Provisions have been added to address a variety of matters not currently addressed by By-law 74-53.
- Part 4 contains the Parking & Loading
requirements.
– This section sets minimum number of parking spaces based on the use. In some cases, a minimum number of loading spaces will also apply. – Establishes requirements (setbacks, landscaping, etc.) for driveways and parking areas in all different zones.

What does the proposed zoning for Schomberg look like (4 of 8)?
- Part 5 identifies the Zones and
Maps.
– Schedule “A” zones all lands in Schomberg with a particular zone
- category. In total, 24 zones are
- identified. The zones are shown on
Schedule A. – Part 5 also defines the various overlays and suffices applied in certain areas, such as the holding symbol (H) which is applied to some areas.
- Parts 6 through 9 outline the provisions
that apply to the defined zone categories.
– Part 5 also includes provisions for ensuring the maps are interpreted consistently.
List of Proposed Zone Categories Residential Zones
R1, R1A, R1B, R1C, R1D, R1E, R1F, R1G and R1H The R1 and variations of the R1 zone is applied to lots with single detached dwellings. Generally speaking:
- R1 is used for newer residential areas.
- R1A is a zone created to be applied for future development.
- R1B through R1H provide specific provisions that reflect certain neighbourhoods. These zones are
applied to various established neighbourhoods in King City, Nobleton and Schomberg. R2 This zone is applied to semi-detached dwellings. R3 This zone is applied to townhouse dwellings. R4 This zone is applied to multi-unit buildings, such as apartment buildings and retirement homes.
Commercial Zones
CAS The Core Area – Schomberg zone applies special design standards and provides for a mix of uses in Schomberg’s core area. This is a new zone. A similar zone was created for Nobleton (CAN) and for King City (CAK). C1 The Commercial General zone is used for a variety of commercial uses. This zone is not applied to any lots in Schomberg, but is used in other areas of King City and Nobleton. C2 The Commercial Highway Zone is used for highway-oriented commercial uses. C3 The Commercial Shopping Centre zone applies to newer commercial areas, including the commercial shopping area in the vicinity of Highway 27 and Dr. Kay Drive.
Employment Zones
E1 The Employment - Restricted zone is used for various light industrial and employment uses, such as
- ffices.
E2 The Employment – General zone provides for a wide range of industrial and employment uses.
Other Zones
I The Institutional zone is used for Township and government facilities, including community centres, as well as places of worship and schools. F The Future Use/Development Zone is applied to areas intended for future development. Only existing uses are permitted for lands zoned F. OS The Open Space zone is used for parks. EP The Environmental Protection zone is strictly limited to conservation uses, to protect natural features and to recognize hazardous lands.

How have the key issues been addressed?
- The Discussion Paper presented several key issues to be addressed through this review. The
approach for addressing some of the key issues are described as follows:
Key Issue How was this Issue Addressed in the Draft Zoning By-law?
The development of a new Zoning By-law represents an opportunity to modernize and improve the clarity
- f the Zoning By-law.
- Defined terms and consistent use of defined terms have been implemented throughout the Zoning By-law.
- Zone exceptions are consolidated into the By-law.
- The General Provisions have been updated to address modern zoning practices and new issues not previously addressed.
- Illustrations, an index of defined terms and italicized defined terms have been integrated to provide convenience for readers.
- The By-law integrates a new, modern format and structure.
There is a need to conserve the character of stable residential neighbourhoods.
- New zone categories have been developed and applied to the established neighbourhoods of the community which better
reflect current setbacks, building heights, and other characteristics.
- Special front yard provisions apply within the established neighbourhoods (Section 3.17).
- Some developments were associated with zoning amendments at the time of development, and any such amendments have
been integrated into the Draft Urban Areas Zoning By-law.
- These approaches have integrated input received from the community at the July 12 mature neighbourhoods workshop.
There is a need to implement the design, density and permitted use policies for Schomberg’s Main Central Area, to assist in creating a mixed use, walkable built form, in accordance with the Schomberg Community Plan.
- New Core Area – Schomberg (CAS) Zone incorporates minimum and maximum front yard setbacks and minimum building
heights to help conserve the historic Village core and support appropriate and compatible development and adaptive reuse.
- The new CAS zone is applied only within the Main Central Area Commercial designation of the Schomberg Community Plan.
There is a need to implement the Special Policy Area within Schomberg’s Core Area, which provides for limited development within an area known to be associated with flooding risks.
- Much of the zoning within the Schomberg core area is subject to the “–SPA” suffix, which applies special provisions.
- The special provisions prohibit certain sensitive uses from being located within this area (e.g., schools and hospitals).
- Other less sensitive uses will be subject to flood-proofing standards determined by the Township and the Lake Simcoe Region
Conservation Authority. There is a need to implement the Source Protection Plan.
- New Schedule “B” and associated general provisions implement restrictions on uses to protect source water within the
wellhead protection areas.
