HOUSING FOR GENERATIONS: ADUs in ENCINITAS State Laws - 2016 • Effective January 1, 2017 • Nullified existing Encinitas ordinance City Ordinances – 2018 • Accessory and Junior Accessory Dwelling Units (ADU and JADU) • Council Approved February 14, 2018 • Coastal Commission Approval December 13, 2018 SB 1226: Retroactive Permits - 2018 • City sponsored bill, approved September 30, 2018 • Building officials make determination of when a residential unit was constructed, and issue a retroactive building permit based on the standards of that time

HOUSING FOR GENERATIONS: ORDINANCES Development Standards Number of units Allow up to one ADU and one JADU per single-family dwelling Maximum unit size 1200 square feet or the floor area of the primary residence, whichever is less • Same as existing primary dwelling Front-yard setback • No additional setback required for an existing garage that is converted to an ADU • Same as existing primary dwelling or 5 feet, whichever is less Side-yard setback • A minimum setback of 5 feet shall be required for an ADU constructed above an existing garage Same as existing primary dwelling or 5 feet, whichever is less, plus state regulations when Rear-yard setback applicable 6

HOUSING FOR GENERATIONS: ORDINANCES (continued) Development Standards One parking space required for most newly constructed units unless the unit is : • Within ½ mile of “public transit” (train station and all bus stops) Parking • Created within the area of an existing structure • In a historic district • Based on existing zoning Lot coverage • 5% additional for an ADU built on lots smaller than 10,000 square feet • Based on existing zoning Floor Area Ratio (FAR) • 10% additional for an ADU built on lots smaller than 10,000 square feet Height One-story limit for new construction when utilizing the setback reliefs Rental An ADU cannot be rented for periods of less than 30 days Fees All City development fees are waived 7

HOUSING FOR GENERATIONS: JADUs in ENCINITAS JADU Standards • Conversion of portion of existing single-family dwelling to include an existing bedroom • 500 square feet maximum • One per lot • Efficiency kitchen required; may share sanitation facilities with primary dwelling • Entries to exterior and to primary residence required • Owner occupancy required • Not a separate unit for consideration of fire ordinances or utility services • Not to be sold separately • Not to be rented for periods less than 30 days • Parking cannot be required
