  2. sexual offense and was determined to be incompetent to stand trial and who s uffers from a mental abnormality or personality disorder which makes such p erson likely to engage in sexual offenses if not confined to a secure facility, commonwealth o r (iii) previously adjudicated as such by a court of the and general lack of power to w hose misconduct in sexual matters indicates a c ontrol sexual impulses, as evidenced by repetitive or compulsive sexual his m isconduct by either violence against any victim, or aggression against any v ictim under the age of 16 years, and who, as a result, is likely to attack ox o therwise inflict injury on such victims because of his uncontrolled or u ncontrollable desires." T he iaw defines "mental abnormality" as "a congenital or acquired c ondition of a person that affects the. emotional or volitional capacity of the p erson in a manner that predisposes that person to the commission of criminal s exual acts to a degree that makes the person a menace to the health and safety congenital or o f other persons." The law defines "personality disorder" as "a a cquired physical condition or mental condition that results in a general lack o f power to control sexual impulses." T he term "sexual offense" includes a number of crimes, such as assault battery i ndecent assault and battery on a child under 14, indecent and person, rape, rape of child, kidnapping, enticing a o n a mentally retarded a p erson for prostitution or sexual intercourse, drugging a person for sexual i ntercourse, inducing a person under 18 into. prostitution, open and gross l ewdness and lascivious behavior, dissemination of matter harmful to a minor t o a minor, posing a child in a state of nudity, and possession of child p ornography. P rosecution Process S ix months before an inmate convicted of a sexual offense is due to be r eleased, the Office receives notice from the DOC, HOC and Parole Board. T he Office reviews materials to determine if the inmate is "likely"asexually d angerous person. If making this determination, this Office reviews the facts o f the sexual offense crime, any sex offender treatment records, risk and p rotective factors, any disciplinary reports of the inmate while incarcerated, a nd the inmate's version of the sexual offense crime. If the Office determines person, a petition a ft er review that the inmate is "likely"asexually dangerous setting sufficient facts to support the allegation. i s filed in Superior Court out P ursuant to G.L. c. 123A, § 12(c), (d), the person named in the petition i s entitled to a probable cause hearing before a Superior Court Justice to the hearing, the person d etermine whether the case should proceed to trial. At h as the right to be represented by counsel, to present evidence, to cross- examine witnesses, and to view and copy all petitions and reports in the court f ile.
