SBE PROGRAM OVERVIEW Commercially Useful Function (CUF) A business performing a CUF is one that does all of the following: • Is responsible for the execution of a distinct element of the work of the contract. • Carries out its obligation by actually performing managing or supervising the work involved. • Performs work that is normal for its business, services and function. • Is not further subcontracting a portion of the work that is greater than that expected to be subcontracted by normal industry practices. SBE PROGRAM OVERVIEW CUF Evaluation TEST • Is the supplier (whether it is the prime or a subcontractor) responsible for the execution of a distinct element of the resulting contract? • Will the supplier actually be performing, managing, or supervising an element of the resulting contract? • Will the supplier be performing work that is normal for its business, services and function? • Is there further subcontracting that is greater than that expected to be subcontracted by normal industry practices ? 23

If work has been subcontracted to another SBE, it will be counted as SBE participation by that other SBE. • SBE Materials Supplier – Count 60% of the costs of the materials and supplies obtained from a SBE materials supplier. . 24

SBE PROGRAM OVERVIEW Calculating Participation Values • Pass Thru/Broker – Count the entire amount of the fees or commissions charged for assistance in procuring or delivering materials and supplies when purchased from a SBE that is not a manufacturer or regular dealer. Do not count the cost of the materials and supplies. .
