SBE PROGRAM OVERVIEW Commercially Useful Function (CUF) A business performing a CUF is one that does all of the following: • Is responsible for the execution of a distinct element of the work of the contract. • Carries out its obligation by actually performing managing or supervising the work involved. • Performs work that is normal for its business, services and function. • Is not further subcontracting a portion of the work that is greater than that expected to be subcontracted by normal industry practices. SBE PROGRAM OVERVIEW CUF Evaluation TEST • Is the supplier (whether it is the prime or a subcontractor) responsible for the execution of a distinct element of the resulting contract? • Will the supplier actually be performing, managing, or supervising an element of the resulting contract? • Will the supplier be performing work that is normal for its business, services and function? • Is there further subcontracting that is greater than that expected to be subcontracted by normal industry practices ? 19

SBE PROGRAM OVERVIEW North American Industry Classification System The NAICS Code – Materials/Equipment/Supplies (Examples) • 239910 Construction equipment rental • 532412 Welding equipment rental • 532490 Rental equipment • 423610 Construction materials/supplies • 423840 Welding supplies SBE PROGRAM OVERVIEW Calculating Participation Values • SBE Trade Subcontractor – Work performed or services provided by the SBE’s own work forces, including the cost of the materials and supplies – 100% – Work performed or services provided by the SBE’s own forces, including the cost of materials and supplies obtained for work, except for materials and supplies purchased or leased from Prime. If work has been subcontracted to another SBE, it will be counted as SBE participation by that other SBE. • SBE Materials Supplier – Count 60% of the costs of the materials and supplies obtained from a SBE materials supplier. . 20

SBE PROGRAM OVERVIEW Calculating Participation Values • Pass Thru/Broker – Count the entire amount of the fees or commissions charged for assistance in procuring or delivering materials and supplies when purchased from a SBE that is not a manufacturer or regular dealer. Do not count the cost of the materials and supplies. . SBE PROGRAM OVERVIEW Participation Strategy #1 Utilization of CUF Approved Suppliers • 60% Participation will be counted toward goal • If the SBE is only a Broker then only the fees/commission will be counted 21
