Project Procurement and Delivery

Current Approach:

  • District focusing on evaluating availability payment based

concession model of delivery.

  • District seeking to utilize two-staged, RFQ/RFP process.

– RFQ phase will focus on team qualifications. – RFP phase will be broken into technical proposal and financial proposal.

Next Steps:

  • District beginning development of RFQ for release Spring 2013.

– 60 day response time for interested parties. – 60 day review of responses. – No more than 4 teams would be short-listed following review process.

  • District currently analyzing potential RFP process to follow RFQ short-listing process (details such as

schedule and stipend under consideration and will be detailed in RFP phase).

  • District currently intending to use “best value” approach for selection of concessionaire to deliver

22-mile priority system.

  • Additional details on procurement method to be included in RFQ. Specific contract provisions TBD

in consultation with short-listed firms during RFP process and during negotiations with selected firm.

  • District is developing policies and procedures for disclosures and conflicts of interest to be

provided to interested proposers during RFQ Phase.

Project Planning and Permitting

  • District recognizes that the environmental review and permitting process is a

critical issue for proceeding with a concession.

  • District is currently proceeding with some level of planning and/or

environmental review process for the majority of project segments.

  • Additional segments are being scheduled for review.
  • Complete update and schedule of completed and underway

planning/environmental review processes will be included in the forthcoming RFQ.

  • Utility and ROW issues may pose similar risk factor. District will provide

updated status for these items in the RFQ.

Project Elements—Bus

  • District beginning process of compiling and analyzing detailed information for

bus services including:

– Condition and ownership of all existing assets, – Status of all existing contractual obligations, – Existing service levels

  • Analysis will also include investigation of concepts for achieving desired

service levels through integration of streetcar and bus services.

  • Results of above analyses will be reported in the forthcoming RFQ.

Project Elements—Streetcar

  • Options for procurement of new vehicles (and the integration of existing

vehicles) are under consideration:

– Integrated procurement with the overall concession agreement, or – Separate procurement process.

  • Off-wire vehicle operating capability key requirement for system. District

continues to investigate technology alternatives. Additional industry input in this area is of particular interest to the District.

  • District is continuing with preliminary system engineering and design
  • exercises. These exercises will form basis of preliminary technical

requirements.

  • Completion of the above analyses will inform the RFQ.

Project Funding/Financing

  • District focusing on evaluating availability payment based concession model of

delivery.

  • District understands there is limited market interest for transfer of certain

revenue risks including:

– Farebox – Property Value Capture.

  • Transfer of risks under potential concession agreement likely to have

significant impact on project schedule and/or require contractual protections.

  • District has unique budget appropriation process and is working to

mitigate/remove uncertainty raised by process.

  • District has no plan to issue debt to finance project. Payment structure must

be consistent with District’s debt limitations & accounting policies.

  • Mayor’s Task force to assist in preparation of final project funding plan.
  • Findings relative to above issues to be provided in forthcoming RFQ.

moving the project forward.

  • Comprised of District government leaders as

well as leaders from local private sector.

  • Role is to work closely with DDOT to develop

both a project funding plan and a plan for

  • verall governance of the program.
  • Findings will be a key input to the RFQ/RFP

process.
