  3. History • 1940's Manufactured Homes (MH) Became Popular After WWII Due To The Housing Shortage • 1947-60,000 Manufactured Homes Were Manufactured/Built • Avg. Size Was 8'x27' • 1954-first 10' Wide MH Produced • 1980- 30% Of All New Housing Units Were Manufactured Homes

Manufactured Home Definition • A Structure, Transportable In One Or More Sections, Which In The Traveling Mode Is 8 Body Feet Or More In Width Or 40 Or More Feet In Length Or, When Erected On Site, Is 320 Or More Ft 2 . The Structure Is Built On A Permanent Chassis And Designed To Be Used As A Dwelling With Or Without A Permanent Foundation When Connected To The Required Utilities, Including The Plumbing, Heating, Air Conditioning And Electrical Systems Contained In The Structure. The Term Includes Any Structure Which Meets All The Requirements Of This Definition, Except The Size Requirements And With Respect To Which The Manufacturer Voluntarily Files A Certificate Which Complies With The Applicable Federal Standards.

  5. Calculations • Calculations Used To Determine The Number Of Square Feet In A Structure Will Be Based On The Structure’s Exterior Dimensions Measured At The Largest Horizontal Projections When Erected On Site.

Manufactured Home Community • Any Individual Site, Area, Tract Or Parcel Of Land Upon Which Four Or More Manufactured Homes Used Or Occupied For Dwelling Purposes Are Parked Either Free Of Charge Or For Monetary Consideration And Shall Include Any Roadway, Building, Structure, Installation, Enclosure, Or Vehicle Used Or Intended For Use As A Part Of The Facilities.

  7. Existing Mobile Home Parks • Existing Mobile Home Parks Which Meet This Definition Shall Be Renamed As “Manufactured Home Communities”

  8. Manufactured Home Site • A Parcel Of Land For The Accommodation Of One Manufactured Home, Its Accessory Building Or Structures, And Accessory Equipment For The Exclusive Use Of The Occupants.

  9. Manufactured Home Operator • A Person Who Is In Charge Of The Operation Of The Manufactured Home Community, Or Who Allows A Lot, Site, Area, Tract Or Parcel Of Land To Be Used For The Parking Or Occupancy Of Four Or More Manufactured Homes.

Why Are We Concerned? • Manufactured Home Communities Offer A High Density Population Setting That May Create Special Problems In Sewage, Water, Solid Waste And Vector Control • Mobility Of The Units Creates Interruptions Of The Water And Sewer Service Increasing Likelihood Of Contamination Of The Systems

  11. Regulations • Effective May 2, 2012 • Permits Required To Construct, Install, Alter, Remodel, Extend And Operate A Manufactured Home Community • Permit May Be Suspended Or Revoked If Inspection Reveals That Regulations Have Been Violated

  12. Construction or Installation Permits (Includes Extending and Altering) • Required – Application, Plans And Specifications Must Be Submitted To The Commissioner • If Construction Or Installation Has Not Begun Within 2 Years, Permit Automatically Expires

  13. Operational Permits • Issued By Local Health Departments • Not Transferable Or Assignable • Expire December 31 st Of Each Year • MHCs In Operation At The Time This Rule Becomes Effective, And Meeting All Applicable Prior Rules, Are Eligible For A Permit To Operate.

  14. Location • Ground And Paved Surfaces In All Parts Of The MHC’s Shall Be Graded And Equipped To Drain All Surface Water In A Safe And Efficient Manner • MHC Shall Be Large Enough To Accommodate Water Supply Systems And Sewage Treatment Systems Where Applicable.

  15. Space Requirements • 3,000 Ft 2 For Single Wide Lot • 4,500 Ft 2 For Double Wide Lot • All MHs Shall Be At Least 15 Ft. From MHC Property Boundary Line Abutting A Public Street Or Highway • At Least 10 Ft. From All Other MHC Property Boundary Lines • There Shall Be At Least 10 Ft. Of Space Between A MH And Any MHC Street, Common Parking Area, Or Other Common Use Area

  16. Spacing Requirements • MH Including Their Porches, Canopies, And Similar Appurtenances, Shall Be Separated From Other MHs And From Other Buildings And Structures By The Following Distances: • Ten (10) Feet Side To Side • Eight (8) Feet End To Side • Six (6) Feet End To End

  17. Accessory Buildings or Structures • All Accessory Buildings Or Structures Shall Be Located To Meet The Following Spacing Distances: • Three (3) Ft. From Adjacent Accessory Buildings Or Structure • Five (5) Ft. From Adjacent Lot If Constructed Of Combustible Materials

  19. General Requirements • Manufactured Homes Shall Be Situated On A Stand • Stands: Maintained To Prevent Heaving, Shifting, Or Uneven Settling Under The Weight Of The MH Due To Frost Action, Drainage, Vibration, Or Forces Acting On The Superstructure Of The MH

  20. General Requirements • The MHC Operator Shall Maintain All Streets, Roads And Walkways In Good Repair • The Owner Of Each MH Shall Place A Marker In A Visible Location On Or Near The MH. Marker Shall Be Clearly Visible And At Least (4) Inches In Height

  21. Water Supply • Shall Be Provided With An Easily Accessible, Approved, Safe Potable Water Source • Minimum ¾” Diameter Riser Pipe Extending Vertically 4” Above Ground • Securely Capped When Not In Use • 10' Clearance Between Water And Sewer Risers

  22. Water Supply • All Water Supplies, Piping, Fixtures Or Other Equipment Serving A MHC Shall Be Constructed, Installed, Maintained, Operated, And Monitored In Compliance With All Applicable Provisions Of This Rule And Bureau For Public Health Legislative Rules: Public Water Systems, Water Well Regulations, Cross-connection Control And Backflow Prevention Regulations

  23. Sewage Systems • Must Be Served By A Sewage Collection And Sewage Treatment System That Is In Compliance With Legislative Rule, Sewer Systems, Sewage Treatment Systems And Sewage Tank Cleaners • State Handles Permitting Systems That Will Have Flow > 3,000 Gpd

  24. Sewage Systems • Minimum 4" Diameter Sewer Riser Pipe And Is Required To Extend 4” Above Ground In A Approximate Vertical Position • All Joints Shall Be Water Tight • Riser Capped Or Plugged When Not In Use, In A Manner That Renders Them Water Tight

  25. Sewage Systems • Approved Fittings Shall Be Made Water And Odor Tight By The Use Of Approved Reinforced, Durable, Impervious Semi-rigid Or Flexible Piping Having Smooth Interior Surfaces And Not Less That Three 3” Internal Diameter

  26. Additional Buildings and Structures • MHC Operator Shall Maintain All Floors, Walls, Ceilings, And Attached Appurtenances And All Fixtures And Equipment Clean And In Good Repair

  27. Garbage • The Storage, Collection, Transportation, And/Or Disposal Of Garbage And Refuse Shall Be Conducted To Prevent Odor, Rodents, Insects And Other Nuisance Conditions.

  28. Garbage • All Garbage And Refuse Containers Shall Be Covered When Not In Continuous Use And Maintained In A Clean Condition And In Good Repair • Shall Have Sufficient Number And Capacity Of Containers To Properly Contain All Waste

  29. Garbage • Central Location For Garbage/Refuse Containers, The Location Shall Be Constructed Of Non-absorbent Material, Such As Concrete Or Asphalt. Shall Be Smooth, Durable And Sloped To Drain And Shall Be Of Sufficient Capacity • Collected At An Interval Not To Exceed Seven (7) Days

  30. Insect and Rodent Control • Grounds, Common Buildings And Structures Shall Be Maintained Free Of Insect Breeding Areas, Rodent Harborage, And Infestation Of Insect Or Rodents Of Public Health Significance • Grass Cut Frequently, And Weeds Eliminated

  31. Insect and Rodent Control • All Exterior Openings Of Management Buildings Or Other Applicable Structures Shall Be Effectively Screened Or Insects And Rodents Excluded By Other Effective Means

  32. Fuel Supply and Storage • LPG Systems Or Fuel Oil Systems Shall Have At Least One (1) Approved, Identified, And Readily Accessible Means Of Shutting Off The Entire Supply • Means Shall Be Located Outside The MH And Shall Be Maintained In An Effective Operating Condition.

  33. Fuel Supply and Storage • LPG Containers Or Fuel Oil Storage Containers Shall Not Be Located Within Or Beneath Any MH, Building, Or Any Other Type Of Enclosed Structure • Shall Not Be Located Within 5’ Of A Door Way Of A Mh, Building Or Similar Structure

  34. Miscellaneous • Persons Owning Or In Charge Of Animals/Pets Shall Comply With All Applicable Laws • Operator Shall Make Available To Incoming Occupants Of The MHC A Copy Of This Rules

  35. Records • MHC Operators Shall Keep A Record Identifying MHs And Occupants • Records Of Occupants Shall Be Available To Health Officer • Records Shall Be Kept For One (1) Year • Records Shall Contain The Name, Mailing Address, And Physical Location Of All MH Occupants

  36. Inspections • At Least Once A Year • Consecutive Violations Is Just Cause For Suspension Of The Permit • A Copy Of The Inspection Report Shall Be Filed With The MHC Operator
