Continuing Authority (CA)

Current Regulation

• Requires all applications to show that a

permanent organization will serve as the continuing authority for the operation, maintenance and modernization of the facility.

• Permits are issued to highest level of

authority unless waived or not available.

CA Preferential Order

• Tier 1: Municipality or public sewer district

that has been designated as a area-wide management authority under Section 208

• f the CWA.
• Tier 2: Municipality, Public Sewer District,
• r sewer company regulated by the PSC

which provides sewage services on a regional or watershed level; CWC approval

CA Preferential Order

• Tier 3: Municipality, public sewer district,
• r sewer company regulated by the PSC
• ther than those established as a Tier 1 or

2

• Tier 4: Any person under complete control
• f and responsible for the water

contaminant source, point source, treatment plant…

CA Preferential Order

• Tier 5: An association of property owners

served by the wastewater treatment facility…. must meet additional conditions provided for in the rule.

• Form B and B2 – Domestic Wastewater

CAFO application

Form A – Industrial Waste and Stormwater

• Permit Writers access information from the

Missouri Secretary of State’s Website to determine the standing of the Continuing Authority.
