(15 + 15 + 56= 86 hours)

  3. Mission of Student Conduct • In accordance with the College mission statement, the conduct process contributes to maintaining a socially and ethical responsibility to the community. The conduct process addresses student conduct by: o Informing students about what student conduct is about; o Ensuring that the student’s right of due process is applied fairly and consistently; o Addressing and holding students accountable for inappropriate behavior and to modify those behaviors deemed inappropriate in order to maintain a positive environment within the campus community; and o Offering educational opportunities for the student to prevent reoccurrence of the violation of the Code of Conduct.

  4. Conduct Process • An incident report is submitted about potential violation(s). • Incident reports can be submitted by a campus community member (staff, faculty, and students) Step 1 • Incident report is reviewed for potential violation(s) by conduct officer; Step 2 • A hearing notice and Procedural Rights of Students will be emailed to students involved in the incident to schedule a meeting with the conduct officer and learn about the potential violation(s) the student is being charged with. Student has 48 hours from receipt of the email to respond to hearing officer Step 3 • Failure to schedule and/or attend the hearing meeting will result in (a) The forfeiture of the student ability to present information on his/her behalf (b) Sanctions being issued to the student without the benefit of his/her input.

  5. Conduct Process Cont. • The Conduct Officer will meet with the student to discuss the nature of the incident and allegations • The student may provide information and/or witnesses for the Conduct Officer to hear and review Step 4 • Upon the completion of the hearing meeting/investigation (depending on number of students involved), the Conduct Officer will weigh the evidence, based upon a preponderance of evidence standards, and draw a conclusion based on that evidence. The Conduct Officer will discuss the sanction(s) being issued for the Step 5 violation(s). Step 6 • The Conduct Officer will email the outcome/sanction letter to the student documenting the sanction(s).

  6. Conduct Process Cont. A student has 48 hours from receipt of the letter to appeal the decision in writing to the Dean of Students or Vice President of Student Affairs, depending on who heard the original hearing. • Appeals must be submitted by the student, not a parent/guardian, friend, family member, or legal counsel/attorney. • The following are grounds for an appeal ✓ (a) The conduct process was not in accord with the rules and regulations governing the College’s conduct process, and this deprivation materially affected the decision or ✓ (b) The finding(s) of the violation(s) is contradicted by new evidence that was not available at the time of the conduct meeting.

  7. Found Responsible - Sanctions  Sanctions are determined based on the seriousness of the incident, the violation(s), the student’s conduct record, among other factors.  When a student violates a policy the goal of the conduct process is to (a) hold the student accountable for their actions and (b) help educate the student so further incidents do not occur.  Multiple policy violations may increase the sanction(s) given.

  9. FAQ’s  Will my parents/guardians be notified if I am involved in an incident? Parents/Guardians will be notified if student is under 21 years old and found responsible for violation of the alcohol/drug policy.  Parents/Guardians will be notified if student is being suspended and/or expelled from the institution.  If the student health or safety is at risk.   As a parent/guardian, how can I help my student in the student conduct process? You can help guide the student through the process  Be supportive of the student while holding the student accountable to the College’s expectations   How is this process different from a criminal process? A student may be arrested and charged for a crime AND required to go through the College’s conduct process . The standard  used at a college is different from a criminal justice proceedings. The College’s conduct process runs separately and often concurrently to any process the law requires. 

  10. FAQs  Will my conduct history affect me applying to graduate/law/medical school or a job (on/off campus)?  Many graduate, medical and law schools request information about a student’s disciplinary history. The College will provide disciplinary history for any students who are sanctioned with disciplinary probation, suspension and/or expulsion.  Will my coach be informed of an incident the student is involved in?  Coaches will be informed once the student has gone through the conduct process. If student is found responsible, then a staff member in Athletics will be informed. The Athletics department has their own conduct process.  Can I withdraw from the College in order to resolve this?  If student withdraws from the College, the disciplinary process will continue. There may be a “hold” placed on the student’s account until the process is completed.
