Background • CION adopted Circular Economy Package on 2 December 2015; • Included revised legislative proposals on waste, which set targets: – For reduction of waste; – To increase recycling; and – To reduce the amount of waste landfilled. • Waste Legislative Package – published in the Official Journal of the European Union Volume 61 on 14 June 2018.

Definitions (Art. 3) • Two new definitions introduced: – Reusable Packaging packaging conceived, designed and placed on the market to be re-used multiple times during its lifecycle for the same purpose. – Composite Packaging packaging made of different materials which cannot be separated and form a single integral unit. • Other definitions have been aligned with those of Directive 2008/98/EC on waste.

  5. Reuse (Art. 5) • MS shall take measures to encourage the increase (i) in the share of reusable packaging placed on the market (POM) and (ii) of systems to reuse packaging in an environmental sound manner (ESM). Examples are: – Use of deposit-return schemes; – Setting of qualitative/quantitative targets; – Use of economic incentives; – Setting up of a min. percentage of reusable packaging POM every year for each packaging stream. • MS may take into account the average share, in the preceding three years, of reusable sales packaging POM for the first time, to attain an adjusted level of the targets

Method for calculating the adjusted target levels and the reusable sales packaging Overall 2025 Average share of Overall share of Target (i.e. 65% by reusable sales packaging waste packaging (max. 5%) recycled in 2025 weight) • Same methodology applies to the targets for single packaging materials; • In case of wooden packaging, MS may also take into account the amounts of wooden packaging that is repaired for reuse in the calculation of the target on wood and overall target; • The CION shall adopt by 31 March 2019 implementing acts establishing rules for the calculation, verification and reporting of data, and for the calculation of the adjusted target levels.

Derogation MS may postpone the deadlines for attaining the targets by 5 years , under the following conditions: The derogation is limited to a maximum of 15 percentage points from a single target or divided between two targets As a result of the derogation, the recycling rate for a single target is not reduced below 30% As a result of the derogation, the recycling rate for a single target for glass and paper & cardboard is not reduced below 60%

Rules on the Calculation of the Attainment of the Targets (Art 6a) Alternative Calculation Method: Output of any sorting operation • The output waste is subsequently recycled; and • The weight of waste materials removed by further preliminary operations is not taken into account. MS may apply average loss rates to calculate the weight of rejects in sorted waste • The CION shall adopt by 31 March 2019 implementing acts establishing rules for the calculation, verification and reporting of data.

  12. Return, collection and recovery systems (Art. 7) • MS shall ensure that, by 31 December of 2024, extended producer responsibility (EPR) schemes are established for all packaging in accordance with Articles 8 and 8a of WFD. As from 2025, major shift in the Packaging and Packaging Waste Directive to the EPR principle

  13. Information Systems and Reporting (Art. 12) • The following new data shall be reported for each calendar year to the CION within 18 months of the end of the reporting year: – Data on the overall reusable packaging POM (tonnes and %) – Data on the material specific reusable packaging POM (tonnes and %) – Data on the overall reusable sales packaging POM – Data on the material specific sales packaging POM. • CION shall adopt by 31 March 2019 a format for reporting and shall cover the data for that reporting period.
