In Idaho the appropriation doctrine is used for the delivery both surface water rights and ground water rights— “first in time is first in right”

Problem Water deliveries must consider connections between ground water and surface water (conjunctive administration) if fair delivery is to be achieved if fair delivery is to be achieved

Three Approaches  Approach 1 – State pays canal companies to  recharge using state water rights.  Approach 2 – State partners with private  Approach 2 – State partners with private companies to incentivize recharge under private companies to incentivize recharge under private rights – the state pays less, and receives its return via uncaptured recharge. This offers the potential for a large return on investment for the state.  Approach 3 – Municipality partners with private  companies to incentivize recharge under private rights.
