Certification and Attestation - Hospitals

• For 2018, CMS will have a 90 day attestation and a 2014 certified

edition is permitted.

• For 2019, CMS will have a 90 day attestation and a 2015 certified

edition is required.

• 2015 Edition CEHRT is required but CMS has not established the

attestation criteria yet. For hospitals, they will be finalized in the IPPS final rule.

• CMS is now calling the EHR Incentive Program, the Promoting

Interoperability Program.

Certification and Attestation - Clinicians

• Eligible professionals under the Medicaid Promoting Interoperability

Program report for a minimum of 90 consecutive days. They may use 2014 or 2015 Edition for 2018 but must use 2015 Edition in 2019.

• The same is true for Medicare eligible clinicians participating in the

Merit-based Incentive Payment System (MIPS) who choose to report for the Promoting Interoperability Performance category.

General Data Protection Regulation (GDPR)

• Requires the consent of subjects for data processing
• Collected data must be anonymized to protect privacy
• Safe handling data transfers across borders
• Providing data breach notifications and a fine up to €20 million or up

to 4% of the annual worldwide revenue

EHR Plus

• The concept of EHR Plus
• The impact of FHIR APIs - Allscripts/Medaware, Greenway/Qardio,

Intersystems/Premera Blue Cross

• The CHRONIC Care Act – passed and signed into law in February 2018

as part of the Bipartisan Budget Act of 2018 – relaxes geographic and facility-type restrictions under Medicare FFS for telestroke services and adds the patient’s home and independent renal dialysis facilities as originating sites for telehealth dialysis services. The CHRONIC Care Act also gives Medicare Advantage plans the ability to offer telehealth services as part of their basic benefit package. For certain accountable care organizations (ACOs), the Act eliminates rural geographic area requirements, and enables homes to qualify as originating sites.
