  3. LAND REGISTER • Established 1979 • Plans essential • Single deed establishes title • Land Certificate

  4. WHY TRANSFER TO LAND REGISTER? • Clarify title extent prior to sale or major disposal/development • 2014 policy statement from Scottish Government: All public sector land to be transferred to Land Register by 2019

  5. ADDITIONAL TITLE MATTERS • Burdens • Third party interests • Servitudes/wayleaves – written and unwritten • Public Rights of Way • Tenancies – short term • long term • Core paths • Tree Preservation Orders

  6. HOW TO EFFECT THE TRANSFER? • Review the Sasine Title • Check legal extent versus occupational extent • Resolve all issues • Additional title matters, e.g. servitudes, burdens • Lodge voluntary registration application and pay Keeper’s fee • Check Land Certificate when delivered

  7. REVIEWING THE TITLE Full examination of title required • All relevant Sasine writs • Update Searches • Plans Report • Note of issues to client (not a full Report on Title)
