Land Use Element

Freight Rail Dependent Uses Overlay This designation is implemented with an overlay zone that identifies parcels where freight rail dependent uses adjacent to the short line railroad may be permitted.

Section 2

(9) "Freight rail dependent uses" means buildings and other infrastructure that are used in the fabrication, processing, storage, and transport of goods where the use is dependent on and makes use of an adjacent short line railroad. (19) "Short line railroad" means those railroad lines designated Class II or Class III by the United States surface transportation board.

Rural and Natural Resource Element

Freight Rail Dependent Uses Goal: Support freight rail dependent uses where the use is dependent on and makes use of the short line railroad, as defined by the Surface Transportation Board.

Clark County Comprehensive Plan changes ESB 5517 Rural and Natural Resource Element Policy 3.9.1: Support freight rail dependent uses in rural lands, as well as agriculture, forest and mineral resource lands, where the use is dependent on and makes use of the short line railroad within the county.

Section 2

(9) "Freight rail dependent uses" means buildings and other infrastructure that are used in the fabrication, processing, storage, and transport of goods where the use is dependent on and makes use of an adjacent short line railroad.

Section 3

Any county located to the west of the crest of the Cascade mountains …may adopt development regulations to assure that agriculture, forest, and mineral resource lands adjacent to short line railroads may be developed for freight rail dependent uses.

3.9.2: Freight rail dependent uses will be allowed

  • n parcels with a freight rail dependent use
  • verlay, where such uses minimize impacts on

adjacent rural and resource uses.

Section 3

(1)(a) Each county that is required or chooses to plan under… shall adopt development regulations…, to assure the conservation of agricultural, forest, and mineral resource lands designated under RCW 36.70A.170. Any county located to the west of the crest of the Cascade mountains …may adopt development regulations to assure that agriculture, forest, and mineral resource lands adjacent to short line railroads may be developed for freight rail dependent uses.

Such facilities are both urban and rural development. Clark County may include development of freight rail dependent uses on land adjacent to a short line railroad in the transportation element of this plan. The County may also modify development regulations to include development of freight rail dependent uses that do not require urban governmental services in rural lands.

Section 5

(2) Any county located to the west of the crest of the Cascade mountains …, may include development of freight rail dependent uses on land adjacent to a short line railroad .... Such counties and cities may also modify development regulations to include development of freight rail dependent uses that do not require urban governmental services in rural lands.

Section 1

Planned and effective access to railroad services is a pivotal aspect of transportation planning. The legislature affirms that it is in the public interest to allow economic development infrastructure to

  • ccur near rail lines as a means to alleviate strains
  • n government infrastructure elsewhere.

Clark County Comprehensive Plan changes ESB 5517 Transportation Element Implementation strategies

  • Ensure that freight corridors are designed,

maintained, and operated to provide efficient movement of truck and rail traffic.

  • Use intelligent transportation system

technology to alert motorists, bicyclists, and pedestrians to the presence and anticipated length of closures due to train crossings.

  • Evaluate the feasibility of grade separation in

locations where train crossings result in significant delays and safety issues for other traffic, and improve the safety and operational conditions at rail crossings of streets.

Section 5

(1) The transportation element required by RCW 36.70A.070 may include, in addition to improvements or strategies to accommodate the impacts of development authorized under RCW 36.70A.070(6)(b), multimodal transportation improvements or strategies that are made concurrent with the development. (2) Any county located to the west of the crest of the Cascade mountains that has both a population

  • f at least four hundred thousand …may include

development of freight rail dependent uses on land adjacent to a short line railroad in the transportation element required by RCW 36.70A.070…

Clark County Comprehensive Plan changes ESB 5517 Transportation Element Implementation Strategies, continued

  • Work with freight stakeholders and the Port
  • f Vancouver to maintain and improve

intermodal freight connections involving Port terminals, rail yards, industrial areas, interchange tracks and regional highways.

  • Support efficient and safe movement of goods

by rail where appropriate, and promote efficient operation of freight rail lines.

  • Identify and minimize impacts that freight

movements have on adjacent residential neighborhoods and on resource uses.

  • Work with local jurisdictions and railroads to

coordinate land use plans and policies to preserve and protect rail corridors, and take into account community needs in relation to the rail system.

Developing the criteria for the overlay

  • Adjacent
  • Not defined in bill
  • Used 500 feet and abutting
  • Exclusion of Rural-5 properties
  • Parcelization
  • Compatibility between freight rail dependent

uses and residential properties

Overlay Zones

An overlay zone is a zoning district which is applied over one or more previously established zoning districts, establishing additional or stricter standards and criteria for covered properties in addition to those of the underlying zoning district.

Rural Lands

The Rural land use designation is intended to provide lands for residential living in the rural area.

  • Consider and recommend development regulations

related to freight rail dependent uses to be adopted in 2018.

  • Review oil classifications in RCW 90.56.010, exclude

energy products and chemicals deemed hazardous

  • Build a list of uses from the bulk commodities that

make up 90% of rail freight

  • Use definition of Freight Rail Dependent Uses in ESB

5517 with particular emphasis on the terms “dependent on” and “makes use of” to refine use list
