Role of the Standing Advisory Committee

Appointed under section 151 Planning and Environment Act 1987 Terms of Reference signed by the Minister define scope:

  • Clause 45.12 ToR- Purpose to advise on site specific controls

to facilitate proposals to redevelop land within Fishermans Bend before the introduction of an Infrastructure Contributions Plan for either: – Land subject to permit applications called in by the Minister before approval of Amendment GC81; or – Other proposals – contingent on responding to policy, meeting GC81 controls and making appropriate development contributions

Operation of the Standing Advisory Committee

  • To start hearings within 2 months of each referral
  • Mandatory considerations include policy, objectives of

Fishermans Bend Framework September 2018, cumulative effect on preferred character, provision of appropriate development contributions, submissions and evidence (clause 20 of ToR)

  • Public hearing for referred proposals (quorum of two members)

  • May inform itself as it sees fit, subject to meeting natural justice

requirements

  • May limit time to present at hearing (clause 35 of ToR)
  • Prepare report to be submitted to the Minister for Planning a

maximum 40 days from conclusion of hearing (clause 42 of ToR)

because no third party rights in relevant planning scheme provisions
