PROCESS DOCUMENTATION REPORT

(DRAFT SDMP PRESENTATION WORKSHOP)

  • I. HIGHLIGHTS

In compliance to the Philippine Mining Act of 1995, TVI prepared/drafted its 5-Year SDMP (2004-2008) and presented for deliberation in a panel composing the major stakeholders such as MGB, SSAI, representatives from the Provincial Environment and Development Office (PEDO) of the Province of Zamboanga del Norte, NGOs and other line agencies for their review and consensus approval to every activity, corresponding cost and its development schedule and target.

  • II. GENERAL OBJECTIVE

Generally, the objective of the workshop was to present/review every development plan, costs schedule, interventions reflected in the 5-year SDMP to host community and impact areas for consensus approval among major stakeholders in the mine.

  • III. THE PROCESS

Schedule and Venue The schedule for the SDMP presentation was arranged by the Multipartite Monitoring Team (MMT) via cellular phone communication held on September 21-22, 2006 at TVI Clubhouse. Facilitator Being the presentor, TVI also acted the facilitation of the activity thru its Community Relations Department headed by Mr. Oscar F. Covarrubias, Jr., as the led office fronting the social development and management responsibilities of the company to the stakeholders. It was formally started at exactly 1:30 in the afternoon with short introductory talks of Mr. Covarrubias and followed with acquaintance of participants.

Presentation Proper/Proceeding Facilitator : Presented the introductory part of SDMP; Bing : Before any, I would like to inform everybody that the proposal for mining forum, mine tours and responsible mining was already approved by TVI top management during our conference in Manila; PEDO : Provincial wide coordination among the target participants of the forum including churches, NGOs, etc. was already done. And we hope it will not be postponed; Bing : The idea to delay the mining forum is considered but the group finds it not viable considering that the invitations were already done by the provincial government; NGO rep : Management system also needs the plenary of forum and workshop; Jack : We need a panel of reactors for anti mining, pro and responsible mining; Oscar : Is there already a program on that? MGB staff : Yes, we have;

  • Atty. Bernardo : We see first the program;

Oscar : I think that the allocated time for each speaker is quite longer. Can we make it 20 minutes to have enough time for the open forum? Atty.Bernardo : Majority of these people are politicians, and we are sure they may not stay ahead

  • f time specially those coming from far places;

Jack : Ok, we settle the 20 minute per speaker. Are all will agree? Majority : Agree. Facilitator : Ok, let’s proceed to SDMP. Let’s start with the legal basis; Jack : We have a new amended IIR. To clarify all statements stipulated in the draft SDMP, let all questions, queries be referred to it; Atty.Bernardo : TVI gave royalty to SSAI after deducting the excise tax, is it realistic or is there any amended provision about it? Jack : Royalty is based from the gross mining and milling costs, if that is the case, you may consult the company about that matter; Facilitator : We go to the SDMP credited activities, we just want to clarify some activities either to include or not to SDMP, example, employees and his/her dependents Jack : Employees and his/her dependents are clearly not included. But any activity/expenditure that has bearing/relation to mining operation can be included. It is only a matter of defining the description and charging to a specific allocation. For example, IEC, scholars, and employees dependents can be charged to the 10% of the 1% MMC. You should only take note that all costs/activities chargeable

  • r subject for assignment from the 10% of 1% must be coordinated and approved

by the MGB. Atty.Bernardo : We noticed the employment status and other things here, these did not follow our MOA & MOU with TVI and this needs a review and might be included in the

  • SDMP. Because when we recommend IP and his document reached to the

personnel department, there always personality changes and our recommended IPs never occupied position. If we compare the benefits between IPs and non-IPs, it is observed unequal (i.e. meals, lodging, etc.). We admitted that majority of us have no skills but let the non-skilled works be given priority to the IPs. Bing : Let us recall the agreement.

Atty.Bernardo : Another thing is the IP SCAAs sudden reduction to its original number, reports said that some IP SCAAs had been replaced by non-IPs. We all take note that SCAA was initiated by IPs and the current physically status became outnumbered. Bing : One consideration of the SCAA coming from other places is that the effect of social consequence. If I am not wrong, kaingin due to household demands become increasing and may be it forecast other social indifferences. Atty.Bernardo : Also, the contractors’ employees are all non-IPs. TVI as part of their contract agreement should see to it or stipulate such provision assuring IPs employment. Bing : There is a social and cultural impact of the employment with the people coming from IP group.

: TVI should reflect the true address of the employees before his/her employment. Records revealed that majority of the employees are from Canatuan which is clearly not true.

  • Capt. Patoh

: Those getting address in Tabayo and not really from Tabayo should be out and replaced with true Tabayo residents. Oscar : I understand that the contention of HR was because non-IPs had no homes here to live. So we will communicate the HR officially. Bing : Indicator among IPs and non-IPs need to be established to avoid repeatation of the case; PEDO : We need to check the specific address of every TVI employee including the contractor. Bason : IPs, kunting kasalanan alis, non-IPs hindi. Bing : If there is a discrepancy of personnel report of IP employment, NCIP should be notified and informed. PEDO : Why are you hiring contractors from other places like Zamboanga City, Zamboanga Sibugay, Pagadian City in fact, we have here in the province? Atty.Bernardo : We expecting results of these problems. Facilitator : Ok, we will continue on the other parts of the draft SDMP. Atty.Bernardo : I have a suggestion specific to exploration activity, before any exploration is made should inform/coordinate the SSAI to avoid overlapping of projects. Because we have future and on-going projects in our CADT area, particularly abaca and rubber plantations, high valued fruit & vegetable crops. Facilitator : Ok, noted. Let us proceed to other parts: the mining project profile and the description of host community and impact areas;

  • Atty. Bernardo : I have correction of the host community. Let us emphasize that host community

is the IP community which refers to CADT or SSAI not Canatuan or Tabayo. Because if SDMP will include other barangays outside CADT, I am sure they will ask equal share on that. And any development intervention should come first to the host community. Jack : We have to go back to the definition of host community and impact areas. Paqueo : Let us first identify barangays within CADT area, how about Pisawak, Bulacan and Makiang?

: Covered.

  • Atty. Bernardo : Barangay Makiang covers only a single tree.

Facilitator : Any further clarifications, suggestions. Majority : None.

Facilitator : Let us now agree with the percent development allocation of the 90% of 1% MMC. Jack : I move for 70-30 sharing mode, 70% for the host community and 30% for the

  • ther impact/affected areas.
  • Atty. Bernardo : I am in favor of 70-30.

Majority : Approved. Facilitator : Let’s go to the accomplishment of TVI from year 2004 to mid 2006: 1) Livelihood 2) Organizational Development 3) Infrastructure Development 4) Capability Building 5) Health and Sanitation 6) Education. On environmental rehabilitation, the company had planted more than 62,000 forest trees as of this period.

  • E. Comisas

: The MMT will validate that accomplishment. Bing : TVI should incorporate in its plan the so-called “Adopt a Mining Forest”, a program of MGB with awards intended for areas affected by mining activities. Facilitator : Currently, we are considering the 2006 SDMP doable activities. So, we can include that in preceding years’ plan. Bing : Do you have the profile of Tabayo? Paqueo : Yes, we have. Bing : What is the method used in the conduct of profiling? Paqueo : 100% household profiling and comprehensive data gathering. MGB staff : Include the profile together with the pro-forma in the submission of SDMP. The SDMP shall be submitted 6 hard copies and CDs.

  • Atty. Bernardo : For livelihood, always see to it that nursery and agro-forestry development be the

primary interventions of SDMP because many of our IP farmers need assistance

  • n that.

Facilitator : Yes, we give priority intervention and the plan does not only limit to that but to entrepreneurial development and enhancement based on our 2006-2008 targets. We just first begin with organizational development and strengthening of existing PO to include CAIMPC, SSAI, Women’s and youth organization which will serve as marketing arm in running the economic activities within the community. Bing : I understand that majority of CAIMPC members including the chairman are TVI employees.

  • E. Comisas

: Yes, almost all are employees. Atty.Bernardo : I agree to have a marketing arm but rest assured that it coming from within the host community so that economic development would still evolve here. Bing : Note to include the track record of the Women’s (goat raising) as part of their development learning process and allocate additional cost for expansion of the project. Facilitator : Ok, noted. Let’s proceed to infrastructure development. Atty.Bernardo : Infrastructure development such as earth movement and the like should be separated from SDMP. We will only allow market establishment for Tanuman Settlement to be included in SDMP. Paqueo : We will just put the organizing component for Tanuman settlement as an addendum to SDMP. Bing : Note also that the education component should touch the preservation of subanen cultural heritage. Facilitator : How about the capability building component? Jack : Settle it to the 70-30 sharing mode.

Facilitator : For health and sanitation, we proposed the allocation of 400,000 for potable water system at Backroad. Atty.Bernardo : I opposed to that plan, it may become useless in the future. Please be noted that SSAI made the clearing of areas, households within MPSA and be transferred to settlement site. Jack : In every development plan, coordinate with your mine planning department to ensure smooth implementation. Atty.Bernardo : Backroad community according to SSAI should be relocated thus the allocation for potable water system would also be assigned to other location.

  • Capt. Patoh

: I ask that in favor for Tabayo. Majority : Ok, let’s assign that for Tabayo. PEDO : Is that amount enough for the project? Atty.Bernardo : We will make it 600,000 for Tabayo. Majority : Approved. Bing : I suggest that CADT beneficiaries will be covered by PhilHealth. Jack : All these things are subject to further review including education (e.g. teachers’ salaries, day care centers, scholarship program) and other components. We will see to it that cost per activity will limit up to a minimum figure to cater other necessary intervention. Facilitator : For infrastructure, we assign cost for 3.5 km road gravelling at JS Perfecto in RT Lim in the amount of 600,000.00. PEDO : RT Lim is not a host community and why are we going to allocate it? Facilitator : JS Perfecto is an impact barangay affected by mining operations. All TVI vehicles, buses, other private vehicles are passing to and from RT Lim, Canatuan and Siocon. Majority : Ok, we settle and approved on that. Facilitator : We move on to the 2006-2008 detailed work and financial plan or program of budget. Jack : I think we need not to tackle over its details. We already settled the 70-30 development sharing scheme for the program of implementation. Facilitator : What is the voice of everybody?

  • Atty. Bernardo : If all are cleared then let us adjourn.

Majority : Adjourn. Facilitator : Since all things (programs, costs schedule and targets) in the draft SDMP are cleared and approved then, the workshop is adjourned. The time is 8:15 in the evening.
