Note: any municipally owned industrial facilities in these categories also requires permit coverage
Who needs permit coverage:
8
Sector A: Timber products Sector AC: Electronic/Electrical Equipment and Components, Photographic and Optical Goods
9
Use the SIC code or narrative activity that: generates the greatest revenue, has the greatest number of employees has the greatest production.
ABC Millwork County Industrial Landfill and Transfer Station
- Primary SIC Code: 2431 (Sector A)
- Secondary SIC Code: 5015 (Sector M)
Primary Narrative Activity: Landfill (Sector L) Secondary SIC Code: 5093 (Sector N) Permit coverage is needed Permit coverage is needed Examples:

Land which has common ownership and is the location of a single corporation, business or publicly owned operation, with a portion engaged in Industrial Activity even if land parcels are separated by a roadway, fence line, or similar boundary.
Definition of a Facility:

Note: These are in DRAFT form and differ from permit language
L1
Municipal Solid Waste Landfill (MSWLF) Areas Closed in Accordance with 40 CFR 258.60
L2
Any Open Or Closed Non-Hazardous Waste Landfills And Land Application Sites, Which Do Not Discharge To Surface Water(s), Stormwater That Has Contacted Solid Waste. L2 Applies To Any Landfill That Receives or Has Received Solid Waste From A Facility Conducting An Industrial Activity. L2 does not apply to Closed MSWLFs Described In L1.
L3
Any Landfill That Discharges To Surface Water(s), Stormwater That Has Contacted Solid Waste. L3 Does Not Apply If Leachate Generated At The Landfill Is Managed In Accordance With Minn. R. 7035.2815, Subpart 9, and Subpart 13 J, K and L.

General Permit requirements: Identify areas at the facility that have potential for soil erosion; and implement BMPs to prevent or control erosion and reduce sediment loads in stormwater discharges. Sector-Specific Requirements: Implement sediment control practices on all down gradient perimeters before any upgradient land disturbing activities begin. Provide temporary stabilization for materials stockpiled for daily, intermediate, and final cover, inactive areas, landfills that have final covers but where vegetation has yet to establish itself, and land application sites where final vegetation has not yet been established.

Reporting is not required from those who can certify for No Exposure
27
Impaired Waters
- 28
Nondegradation
- 29
Future application will have applicability questions
Benefits to No Exposure:
- 1. Conditional exclusion from the industrial stormwater permit
- 2. No SWPPP, no annual fee, no annual reports, no monitoring
- 3. Stormwater contamination is avoided = clean waters
