The 1996 Bill Emerson Good Samaritan Food
Donation Act Protects Businesses from frivolous lawsuits who donate their surplus food to a qualified charity rather than dumping it into a landfill.
The Richard Russell National School Lunch Act was
amended in 2011 to clarify that schools are afforded the same legal protections as businesses for food donations to a qualified charity.
