SEF’s Main Atributions

Grant domestic visas, extension of stay, residence permits, as well as travel documents in accordance with law. Control the movement of persons at border posts, preventing entry or exit from the country of people who do not meet the necessary legal requirements for the purpose. Control and monitor the residence and activities of foreigners throughout the country. Investigating crimes of People Smuggling and Human Trafficking, as well as investigating other related crimes, without prejudice to the powers of other entities.

The Accommodation Bulletin (Boletim de Alojamento), commonly known as BA, is an important tool in foreigners control system in the country. The accommodation bulletin is intended to permit the monitoring of foreign nationals in

Obligation to notify

The companies operating the hotel establishments, complementary tourist accommodation or tourist complexes, as well as all those providing, against payment, accommodation to foreign nationals, are

  • bliged to notify, within three working days.

(Law 29/2012 Art. 16º n.º1) After the departure of the foreign national of that accommodation, this must be reported within the same period. (Law 29/2012 Art. 16º n.º2)

Application

For each foreign citizen, including nationals of

  • ther member states of the European Union, is

filled out and personally signed an accommodation bulletin. (Law 29/2012 Art. 15º n.º2) It is not mandatory to fill or the personal signature of the bulletins by both spouses and children accompanying them, as well as all members of a tour group. This obligation can be fulfilled by one spouse or a member of that

  • group. (Law 29/2012 Art. 15º n.º3)

Aplication

The hotels and similar establishments should proceed to the registration with SEF as users of the Accommodation Bulletins Information System (SIBA), so that they can carry out the respective electronic communication in safety

  • conditions. (Law 29/2012 Art. 15º n.º4)

The bulletins and their respective copies are kept for a period of one year from the day following notification of departure. (Law 29/2012 Art. 15º n.º5)

Santions

  • 1 – The omission of the electronic registration of foreign nationals in accordance

with paragraph 4 of Article 15, or failure to submit the accommodation bulletin, in accordance with paragraph 1 or paragraph 2 of Article 16, is punishable administrative offense with the following fines:

  • a) € 100 to € 500, 1-10 bulletins or citizens whose record is missing;
  • b) From € 200 to € 900, 11-50 reports or citizens whose record is missing;
  • c) From € 400 to € 2000 if there were not sent bulletins or is missing registration

in respect of more than 51 citizens.

  • 2 - In case of negligent breach of the communication of the term of

accommodation or the foreign national exit, the minimum and maximum limit of the fine is reduced to a quarter.
