  • Disability Rights – History – fascinating but lacks diversity (see resources slide for

readings etc.) LEADON Network & NDLA statement on racism and bias in disability rights community and movement (handout)

  • Three “avenues” to this work
  • 1. Paternalistic – we have to take care of PWD
  • 2. Clinical – we have to “cure or fix” them – genetics
  • 3. Civil and Human Rights - PWD can and should live in the community provided with

supports and give opportunities to decent employment, housing and all aspects of life

History: Disability Laws

  • Architectural Barrier Act of 1968 – this created ramps, curb

cuts & accessibility. PWD could get into the restaurant but could still be denied service. https://en.wikipedia.org/wiki/Architectural_Barriers_Act_of_ 1968

  • Rehabilitation Act of 1974 – Section 504 – any entity

receiving federal funding can not discriminate against PWD https://www.disability.gov/rehabilitation-act-1973/

  • Air Carrier Access Act of 1986 – guaranteed PWD would

History Disability Rights Laws– cont’d

  • Americans with Disabilities Act of 1990 (ADA) –This is a wide-

ranging civil rights law that is intended to protect against discrimination based on disability; amended in 2008 (ADAA)

  • There are Five Titles to the ADA – there are no specific statutes
  • n Transportation or Housing as there were laws implemented

prior to ADA that covered discrimination (Fair Housing Act)

  • Civil Rights Act of 1964 – did not include disability in the list of

protected classes – like age, pregnancy - disability was added later

  • Premise of the ADA – Community Integration – the inclusion of

PWD in every aspect of life

ADA – Law

  • ADA Title II and Title III in addition to the civil rights act
  • Title II: This title prohibits discrimination on the basis of disability

by “public entities,” which are programs, services and activities

  • perated by state and local governments. The public entity must

make sure its programs, services and activities are accessible to individuals with disabilities.

  • Title III: This title prohibits private places of public

accommodation from discriminating against individuals with disabilities.

Self Driving Cars

  • National Highway Traffic Safety Administration (NHTSA), U.S. Department of Transportation (DOT) held a public meeting

March, 16, 218

  • where the agency's Vehicle Safety Research and Behavioral Safety Research offices presented information on activities

related to priority research programs in vehicle and behavioral safety, including a focused overview session on NHTSA's research in Automated Driving Systems (ADSs).

  • AV will assist with mobility for all persons with disabilities – mobility, Blind, Low Vision,

Deaf, Hard of Hearing, Developmental Disabilities

  • AV –need for safety systems –inside and outside of the vehicles
  • AV – outreach and future work needs input from all about how this will look
  • Accessibility – not just physical – screens, voice, other AT instruments
  • Equity – the use of these vehicles must include all communities –creation of and use
  • f systems for all (Credit cards, Identification use of names etc.)
  • Licensing – for Blind and Low vision, Deaf and Hard of hearing community - how does

this work ?

  • Next steps – Vans, Buses, Trucks, Emergency vehicles, trains etc. – what does this

mean for people with disabilities and the aging community
