HB0009- Antifreeze and Petroleum Standards Enforcement

  • Current law requires the Director of the Department of Agriculture

to sample petroleum, engine fuel and antifreeze products in all storage tanks that supply the products to retailers yearly. Current law also authorizes the Director to collect samples from pipelines, storage or transport tanks at refineries and intermediate storage facilities as the director deems necessary.

  • This act eliminates the yearly requirement and instead authorizes

the Director to periodically collect samples from all locations from which the director may currently collect samples. The act reorganizes the language of the statute but maintains the process for collecting samples from retail facilities. Effective July 1, 2019

HB0076- Wyoming Beer Freedom Act

  • Authorizes microbrewery permit holders to hold malt beverage permits

for the purpose of selling the permittees’ own brewed malt beverages.

  • Under Wyoming law, the holder of a microbrewery permit is not

authorized to also hold a twenty-four (24) hour malt beverage permit, which authorizes any responsible person or organization to sell malt beverages at a picnic, bazaar, fair, rodeo or similar public gathering.

  • This act eliminates this prohibition, allowing a holder of a microbrewery

permit to obtain a twenty-four (24) hour malt beverage permit, but

  • nly for the purpose of selling its own brewed malt beverages.
  • Effective July 1, 2019

SF0057: Public Records

  • This act amends the statutory provisions governing public records and creates the following short title for

those provisions: "Public Records Act."

  • The act:

– Requires governmental entities to designate a public records person and requires applications for public records to be made to the designated public records person; – Requires the Department of Administration and Information to post contact information of the designated public records person on the Department's website; – Defines governmental entity to mean the state of Wyoming, an agency, political subdivision or state institution of Wyoming; – Requires the release of public records not later than thirty (30) calendar days from the date of acknowledged receipt of the request unless good cause exists, in which case the records shall be released on a specified date mutually agreed to by the applicant and the governmental entity; – Requires the Governor to designate an ombudsman to receive complaints for violations of the Public Records Act and authorizes applicants of public records to file a complaint with the ombudsman; – Authorizes the ombudsman to mediate disputes, prescribe timelines for release of records and waive fees charged by a governmental entity.

  • Effective July 1, 2019

SF0068: Meat harvested from livestock

  • r poultry
  • Prohibiting misrepresentation of a product as meat that is not derived from

harvested livestock, poultry, wildlife or exotic livestock.

  • This bill prohibits labeling, advertising or other sales promotion that represents a

product as "meat," or any synonymous term for meat, or a specific animal species, unless that product meets the definition for "meat" as provided in the bill and is derived from harvested livestock, poultry, wildlife or exotic livestock.

  • The bill requires cell cultured or plant-based products that do not meet the

definition of "meat" and are not derived from harvested animals to be clearly labeled to indicate that the products are cell cultured or plant-based.

  • The bill requires the Department of Agriculture to promulgate rules with respect to

labeling.

  • The bill is effective immediately for the purpose of requiring rule making, but
  • therwise is effective July 1, 2020.

HB0171: Hemp, cannabidiol and other controlled substance regulation

  • This bill removes hemp and hemp products from regulation by the Wyoming

Controlled Substances Act.

  • The bill requires the Attorney General, as Commissioner of Drugs and Substances

Control, to conform Wyoming's controlled substance regulations to changes in federal law within a specified time period.

  • The bill authorizes hemp production and hemp processing and provides

rulemaking authority to the Department of Agriculture.

  • The bill requires the Department of Agriculture to submit a state plan for the

regulation of hemp to the United States Secretary of Agriculture.

  • Requires a report from the Department of Agriculture to the Joint Agriculture,

Public Lands and Water Resources Interim Committee and the Joint Appropriations Committee on the production and processing of hemp. Effective Immediately
