  4. MCSAP Planning Meeting and Grants Training – 2017 • Became law on December 4, 2015  Pub. L. No. 114-94 (Dec. 4, 2015); Title V, Motor Carrier Safety • Several provisions impacting FMCSA Grant Programs • Consolidation – Seven programs restructured into two Pre-FAST FAST MCSAP High Priority 4

MCSAP Planning Meeting and Grants Training – 2017 Grant Program Changes – Highlights • MCSAP Expanded:  Now includes New Entrant, Border and components of other discretionary enforcement programs • High Priority Grant Program expanded to include:  Information Technology Deployments (ITD)  Data Quality  Performance and Registration Information Systems Management (PRiSM)  CMV Safety and Enforcement initiatives (classic High Priority Program) • MCSAP Formula Working Group  Development of new MCSAP allocation formula.  Working Group scheduled to submit new formula recommendation April, 2017 5

MCSAP Planning Meeting and Grants Training – 2017 Grant Program Changes – Highlights Interim Funding Formula •  Prior to development of new allocation formula (use in FY 2017 – FY2018?)  Calculate funding using MCSAP formula used in FY 2016; PLUS  Average funding awarded to a State for FY 2013, 2014, & 2015 for Border & New Entrant grant awards Federal share for FMCSA grant programs is now at least 85 percent. • States are required to establish a New Entrant Safety Audit Program • and participate in PRISM. Traffic Enforcement •  States may use up to 10% for non-CMV enforcement  Ensuring safe operation of CMV’s  Must maintain average minimum level of CMV safety activities from FY 2004 & 2005  Higher percentage possible with Secretary approval 6

MCSAP Planning Meeting and Grants Training – 2017 Grant Program Changes – Highlights • Commercial Vehicle Safety Plans (required for MCSAP funds)  CVSPs must be posted on FMCSA website within 30 days of approval  Multi-year Plans may be submitted (FMCSA Beta testing this Fall)  Must redact sensitive information the States request be removed • Enroute inspection of CMVs transporting passengers – weigh station excluded as acceptable location (unless imminent/obvious hazard)  Bus station, terminal, border, crossing, maintenance facility, destination, or other location where a motor carrier may make a planned stop. • Non-Compliance Withholding  Staggered for substantial noncompliance  5, 10, 25, then not more than 50% 7

MCSAP Planning Meeting and Grants Training – 2017 Multi-Year CVSP’s • FMCSA released Federal Register notice  October 20, 2016  Fourteen questions relating to length of plan and other important facets  Received twenty-four responses from States and other stakeholders • Official responses will be posted in Federal Register  In final review now • Break-out session to review beta-test plan  Seeking ten States (have six) and one additional Territory  Beta testing will start with FY 18 (this year).  Three-year plan (goals, objectives, etc.) budget for  Discussion/feedback during session 10

MCSAP Planning Meeting and Grants Training – 2017 MCSAP Formula Working Group • Established: By Secretary 180 days after enactment. • Consists of: FMCSA, State lead agencies (must be 51% of group), an organization representing State agencies, and others • Submit Recommendations: For new MCSAP allocation formula within 1 year after establishment • Interim Funding Formula: Prior to development of new allocation formula – Calculate funding amount using MCSAP formula used in FY 2016 – Award average funding to a State for FY 2013, 2014, & 2015 for BEG and NE 11

MCSAP Planning Meeting and Grants Training – 2017 Effort - Focused Analysis • Considered previous MCSAP allocation formula’s design as baseline for improvement • Worked to analyze the elements of that formula and the data sources used for calculations • Considered impacts of the grant consolidation and new State match  The actual percentage of the State match was not part of the Working Group’s charge as the FAST Act already set forth this amount • Worked to ensure the formula would continue to provide adequate funding for the programs now combined into the MCSAP Basic program 13
