Why do we need national implementation rules? • New (future) Royal Decree • No repetition of the EU Regulation! • Regulation directly applicable • Executing/complementary to Regulation 2019/947 • Where a choice is left to the member states • Repealing the existing national rules (R.D. 10/4/2016) 5 Implementing the European drone regulation in Belgium

How will the royal decree affect drone operators?(1/4) • Competent authority : • BCAA • Minimum age for pilots : • OPEN A1/A3 = min. 14 years old • OPEN A2 and SPECIFIC: remains min. 16 years old • Online training and exam for pilots in OPEN category : will be provided by BCAA: • A1/A3: online training + theoretical test • A2: additional theoretical test in FOD/SPF offices 7 Implementing the European drone regulation in Belgium

How will the royal decree affect drone operators?(2/4) • Training requirements for the ‘LIMITED OPEN’ category • Similar requirements as for open category • Training for pilots in SPECIFIC category : to be provided by recognised or designated entities • Exemptions for national drone pilots : • Class 2 certificate + training & test on Regulation = “proof of completion of an online theoretical knowledge examination for remote pilot competency” A1/A3 • Class 1 license + training & test on Regulation = idem + “certificate of remote pilot competency” A2 8 Implementing the European drone regulation in Belgium

How will the royal decree affect drone operators?(3/4) • No conversion of declarations (“class 1B”) nor authorisations (“class 1A”) • Due to lack of equivalence • Procedure for establishment of geographical zones : • Decision of Minister of Transport and/or DG BCAA • Based on advice of BCAA, after consultation of stakeholders • At initiative of BCAA or on demand • National (Belgian) standard scenarios : • Decision of Minister of Transport 9 Implementing the European drone regulation in Belgium

ALL categories : OPEN category : SPECIFIC category : • Do safety promotion • Provide online • Confirm receipt of theoretical training declarations (STS) • Provide the Belgian and test (A1/A3) registration system • Provide • Organise additional authorisations • Assure incident theoretical exams management • Provide Light UAS (A2) Operator • Define geographical Certificates (LUC) zones • Perform risk-based • Enforce the rules (in oversight (audits and collaboration with inspections) local law enforcement) • Designate or recognise entities 11 Implementing the European drone regulation in Belgium

Transition for Belgian pilots and operators • Can a drone operator still operate with a Belgian declaration/authorisation/derogation after 2020 ? • Can a drone pilot still fly with his Belgian certificate/license after 2020? • Can I still fly with my drone ( without CE-class marking )? • What should a Belgian drone operator do to migrate to the EU system? • What should a Belgian pilot do to migrate to the EU system? 15 Implementing the European drone regulation in Belgium

Can a drone operator still operate with his Belgian declaration/authorisation/derogation after 2020? • Yes, declarations (class 1B) and authorisations (class 1A), including derogations, keep their original validity, but not later than 1 January 2022 • Obligation to register as an operator and to respect geographical zones • However, BCAA recommends to switch to EU system ASAP 16 Implementing the European drone regulation in Belgium

Can a drone pilot still fly with his Belgian certificate/license after 2020? • All pilot certificates (class 2 and class 1) remain valid until 01 January 2022 • Allows flying in Belgium, e.g. for class 1 operations under Belgian operator’s declaration or authorisation • However, BCAA recommends to switch to EU system ASAP 17 Implementing the European drone regulation in Belgium

Can I still fly with my drone (without CE-class marking)? • NON-Cx-COMPLIANT drones are still allowed to be operated • In ‘ Limited Open’ category up to end of 2022 • Non-privately build NON-Cx-COMPLIANT drones are for an unlimited period still allowed to be operated, when placed on the market before 1 January 2023: • In A1 conditions if MTOM < 250g • In A3 conditions if MTOM < 25kg 18 Implementing the European drone regulation in Belgium

  19. What should a Belgian drone operator do to migrate to the EU system? 1. Familiarize yourself with the new EU system 2 . Evaluate your intended operations and needs If Open category is sufficient for your operations: • Determine your subcategories of operations • Take appropriate action on pilots and drones If not, check the Specific category: • File declaration if STS • Prepare a SORA and apply for an authorisation • Or set up a (safety) management system and apply for an LUC 3. Always follow the rules incl. operator registration, geographical zones, insurance … 19 Implementing the European drone regulation in Belgium

  20. What should a Belgian pilot do to migrate to the EU system? 1. Familiarize yourself with the new EU system 2. Evaluate the needs of your operator(s) If you intend to fly in Open category operations: • Competency requirements depend on subcategory • Theoretical training and tests provided by BCAA If you intend to fly in Specific category operations: • Remote pilot competence requirements in STS / authorisation / LUC • Training by recognized/designated entities 3.
