3ZA Purpose of planning (as inserted by section 1 of the 2019 Act) (1) The purpose of planning is to manage the development and use of land in the long term public interest. (2) Without limiting the generality of subsection (1), anything which— (a) contributes to sustainable development, or (b) achieves the national outcomes (within the meaning of Part 1 of the Community Empowerment (Scotland) Act 2015), is to be considered as being in the long term public interest. (3) This section applies only to the Scottish Ministers’ and planning authorities’ exercise of functions under Parts 1A and 2.

  • where a Planning Authority has reached the

Proposed Plan consultation stage for their emerging plan by Quarter 4 2021 they will be able to proceed to adoption/approval as per the existing provisions and procedures in the 1997 Act (introduced by the 2006 Act)

  • Emerging LDP’s which have not reached the

Proposed Plan consultation stage by Quarter 4 2021 will be subject to the new process introduced by the 2019 Act and these plans should be prepared and planned for on that basis

Transitional Arrangements – Other

  • Preparation of RSS particularly during the transition period.
  • At present there is meant to be alignment between development plans, local

housing strategies and HNDAs (SPP para 114). With LDPs moving to a 10 year timescale, and the LHS remaining 5 yearly, it is not clear how this alignment will be achieved in the future. Again this may be a matter for NPF4 and development plan guidance, but it is also, to some extent, a transitional issue.It would be really helpful if some advice could prepared on those circumstances.

  • The guidance seems to be encouraging planning authorities to take forward LDPs

under the existing system as the alternative would be to wait until 2021 to start the LDP process. In the SESplan context, without any up to date strategic guidance what are the local authorities to use as a context.

  • It’s difficult to see how to justify the inclusion of some elements of the new system

(for example Local Place Plans) when preparing a plan under current regulations. Adding elements that are not required by statute will be time consuming and will have a financial cost.

  • How are Local Place Plans to be facilitated and considered in the transition period?
