House Bill 1 (General Appropriations Act)

Rider 47. Transportation Infrastructure Fund. Out of amounts appropriated above to the Department of Transportation, $125,000,000 from any available source of revenue shall be allocated to provide grants for transportation infrastructure projects under Subchapter C, Chapter 256, Transportation Code. It is the intent of the Legislature that this allocation of funds is a onetime allocation for the fiscal biennium ending August 31, 2021.

Senate Bill 500 (Supplemental Appropriations Act)

SECTION 78. In addition to amounts previously appropriated for the state fiscal biennium ending August 31, 2019, $125,000,000 is appropriated from the economic stabilization fund to the Department of Transportation for the two-year period beginning on the effective date of this Act for Strategy A.1.8., Construction Grants and Services, as listed in Chapter 605 (S.B. 1), Acts of the 85th Legislature, Regular Session, 2017 (the General Appropriations Act), to provide grants for transportation infrastructure projects under Subchapter C, Chapter 256, Transportation Code.

HB 4280 modifies the formula for distributing grants:

  • 10% - weight tolerance permits ratio, as determined by the Texas Department of

Motor Vehicles;

  • 20% - oil and gas production taxes ratio, as determined by the Texas Comptroller of

Public Accounts;

  • 45% - horizontal well completion ratio, as determined by the Railroad Commission of

Texas (RRC)

  • 10% - volume of oil and gas waste injected ratio, as determined by the RRC; and
  • 15% - vertical well completion ratio, as determined by the RRC.

County Requirements: (Statutorily Required)

  • Submit supplemental road condition report summary (Tex. Transp. Code § 251.018)
  • Detail and list the scope of transportation infrastructure projects to be funded
  • Provide matching funds:
  • 20% of grant amount or
  • 10% of grant amount, if county has been declared economically disadvantaged

Texas Transportation Commission 2020 economically disadvantaged county list adopted September 2019 Minute Order #115595 Criteria An economically disadvantaged county, when compared to other counties in the state, has the following characteristics:

  • Below average per capita taxable property value
  • Below average per capita income
  • Above average unemployment

TxDOT identifies counties that meet all three criteria on an annual basis using data from the Texas Comptroller of Public Accounts.

New to the CTIF program

Requires a county that enters into a contract for a transportation infrastructure project that involves construction or maintenance of roads funded by a grant:

  • Advertise for bids for the contract;
  • Receive competitive bid for the contract, publicly open the bids and read aloud

the names of the bidders and their bids; and

  • Award the contract to the lowest bidder.

A grant awarded under this subchapter must be spent not later than the fifth anniversary of the date of the award.
