The BSIF British Safety Industry Federation is the UK’s Leading Trade Body for the Safety Industry. We currently represent Manufacturers, Distributors, Importers and Service Providers within Safety & Health markets. We are passionate about the Safety & Health, the needs of the UK market, our members and the country’s work force. We are committed to our aims of remaining a positive force for good. Our unique position in the market, plus active input with Government departments puts us firmly at the forefront of influencing legislation. This presentation is to help you, as potential end users of PPE (Personal Protective Equipment) and Safety Equipment take on board some of the changes in the supply chain of PPE. Since April 2018 we have a new Regulation covering the supply of Personal Protection Equipment. At the end of this presentation you will have a better understanding of this important industry sector and I will show how you too can be involved in its future

- One of the first ‘New Approach’ Directives
- Preceded the ‘New Legislative Framework’
- Overtaken by technology and needed improvements
- In revision for over 5 years
- New Regulation adopted in February 2016

The New PPE Regulation (EU) 2016/425
- In force from 21 April 2016
- Applicable from 21 April 2018, when Directive was repealed
- Products CE marked under the Directive can be supplied until 21 April
2019
- EC type-examination certificates remain valid until
- 21 April 2023 unless they expire before that date
- All new EU type certificates will be valid for 5 years. Under the old
Directive this was left open ended? Which is good BUT there is no need for products to be reviewed if no changes have occurred.

- No product examples; categories defined by risk

- New term: ‘Economic Operators’
– Manufacturer, Authorised Representative, Importer or Distributor
- With new obligations
– Record keeping and verification obligations up and down the supply chain Importers and Distributors who market PPE under their own name or brand assume all the obligations of a Manufacturer
Under the Old PPE Directive 89/686/EEC Manufacturers had all the legal responsibilities of product compliance ongoing, and was very much open to national interpretation. The new ‘Regulation’ has shifted up several gears with new Legally binding Responsibilities and Obligations :
General Obligations on Economic Operators (the people you buy from)
- An EU Declaration of Conformity (DoC) must accompany each item of PPE, or
include a web address where the DoC can be accessed. The user instructions must be with the product also & in the language of the end user country
- Economic operators must keep the technical documentation and the DoC for
10 years after the PPE has been placed on the market
- Manufacturers shall ensure that procedures are in place for series production
to remain in conformity

Obligations on Distributors
- Shall act with due care.
- Shall verify that the PPE bears the correct markings and is accompanied by the
required documents in a language that can be easily understood by the consumers.
- Shall not make PPE available in the market if the PPE is considered not to meet
the essential health & safety requirements.
- Shall ensure that records of conformity are kept for 10 year period
- Shall ensure transport and storage does not jeopardize the PPE’s conformity
- Shall take corrective actions in case PPE is considered to be non-compliant and
inform the competent authorities in case PPE presents a risk

Conformity Assessment Procedures
- All certificates have a 5 year validity from 21st April
2018
- By 21st April 2023 all certificates will require renewal
- By 21st April 2023 all products will be certified to the
lastest version of their standard

All these updates are very good as long as there is adequate, effective Market Surveillance in place. Unfortunately our area of concern has very little, meaning that right now the door to counterfeit and non conforming PPE/Safety Equipment is wider than ever before. That’s where The BSIF has stepped in.

- RSSS Scheme members will have one product item from their main product line randomly selected
and tested once a year (One test from one applicable standard clause) The results of which will be fed back to the individual client only - to act upon in the event of a failure.
- We will work with our members to help De-select non compliant goods in our market, In doing so
we will ensure Scheme members are selected to provide Good safe product.

- Individuals. What Qualifies a business to Sell Safety an Health
Products? Nothing is the simple answer. But not any more, now we have the….
- The Safe Supply Accreditation Course for customer facing staff, which will illustrate their expertise
and knowledge to the end user directly.
- Users of safety & health products deserve good products and capable suppliers and support. Users
will get that from a BSIF Registered Safety Supplier.
- An E-Learning module course, with a BSIF OFQUAL certified course qualification at the end of a
successful candidate entry – letting every possible client know that you’re supplying goods from a position of knowledge and care.
- Upon successful completion then Candidates can go forward to complete further expertise course in
more ‘In depth’ areas of Safety/PPE – Fall arrest, Safety Footwear etc.
- Members can then have; not only the expertise on hand in all areas, but the proof to display this
confidence to their end users.

The new PPE regulation requires that the supply chain, importers and distributors have clearly defined
- bligations and responsibilities for quality and management systems which we audit. As you can see this
is supported by Trading Standards through which we have a Primary Authority Agreement

What you can help to do? Be aware of the new Regulations and support our efforts to provide you with market surveillance
End User Companies, through their own Risk analysis process should by now be looking at sourcing supply of PPE from Regulation 2016/425 compliant companies. This is the safest option for them, to trade with for their PPE/Safety needs. The Registered Safety Supplier Scheme allows these buyers to select compliant companies from within membership ranks of the RSSS. Our listings of compliant companies that display the shield is growing right now. But we need your help to spread awareness. Not only does it help you find a supplier but it offers all end user companies a way to support us, in so doing to benefit from a unique free reciprocal
