Riverby Ranch Restoration LLC - $136,300,000  Mitigation Resources of North America - $199,500,000 o Evaluated based on;  Price  Team qualifications & Experience  Project approach – design and construction  Project approach – maintenance and monitoring o Interviewed  RES Texas Mitigation and Ecosystem Investment Partners  Mitigation Resources of North America declined RES Texas Mitigation – Ranked as the Best Value Proposer o

NTML PROGRAM – MITIGATION FSP PROPOSAL DETAILS CLICK TO CLI TO EDIT EDIT MAST MASTER TITLE TITLE ST STYL YLE • RES Proposal Details o RES assumes all risk in meeting USACE performance criteria for 20 years o 100% performance bond during construction w/ decreasing penal sum through maintenance and monitoring period o Proposal only included Riverby and Upstream mitigation areas o Price proposed for these two areas = $126,238,121 • Addressing the Additional Acreage Requirements o Identified discrepancy of 500 acres available at Riverby Ranch o Concurrent w/ FSP procurement, FNI and NTMWD staff developed a proposal to address the shortage o Meeting with the USACE on June 25, 2018 was very positive  Requires a formal transmittal of the plan on letter after jurisdictional determination is complete  Tentative USACE meeting scheduled on August 6th o RES was asked for a proposal to include these properties  Asked for a proposal after RES was identified as the best-value proposer

NTML PROGRAM – MITIGATION FSP ADDITIONAL ACREAGE OPTIONS CLICK TO CLI TO EDIT EDIT MAST MASTER TITLE TITLE ST STYL YLE • There are options to address additional acreage o Option 1 – Plan presented to USACE on 6/25 (No new property acquisition required)  RES price to mitigate = $9,759,869  Properties are smaller and dispersed resulting in much higher costs  ($126,238,121 + Ad Memo – Not-to-exceed amount of $135,997,990 $9,759,869) o Option 2 – RES-proposed option (Requires property acquisition by RES)  Combination of property adjacent to Riverby RES has under option contract and NTMWD-owned property (one tract)  RES price to mitigate = $9,305,866 (includes property cost)  Cost to mitigate is less since it’s mostly adjacent to Riverby Ranch  Total cost of $135,543,987 ($126,238,121 + $9,305,866) o Project team continues to negotiate with RES and coordination efforts with the USACE  Potential amendment to be presented to the Board for approval in August

  16. BEAR CREEK SUD PROPERTY REQUEST • April 2018 Bear Creek SUD (BCSUD) inquired about NTMWD vacant land adjacent to their pump station to build additional ground storage tanks • NTMWD Board authorized purchase of 5.68 acre tract in June 1989 for $35k for the purpose of establishing a pump station to support Farmersville treated water line. • The NTMWD never built nor requires a pump station at this site. There are no other foreseeable plans to use this property • BCSUD is a governmental entity, allowing NTMWD to enter into an ILA • Appraisal of the property would be conducted prior to sale • Recommending the Board to declare property excess and initiate Inter- Local Agreement (ILA) with BCSUD
