 Authority: All sewerage systems and sewage treatment works shall be

under the general supervision of the Board. The regulations of the Board shall govern the collection, conveyance, treatment, and disposal of

• sewage. Va. Code § 62.1-44.18

 Process: Certificate to Construct Facility; Virginia Pollution Abatement

Permit; Certificate to Operate Facility.

 Status: Certificate to Construct – issued; Virginia Pollution Abatement

Permit – Processing.

State Regulatory Process and Status

 State Corporation Commission

 Authority: Regulate formation, operation, financing, and rates of Public

Utilities.

 Process: Charter, Operations, Rates.

 Corporate Charter issued for Public Service Corporation. Virginia Code § 13.1-620.  Obtained a Certificate of Public Convenience and Necessity authorizing it to

furnish sewer service from State Corporation Commission. Virginia Code § 56- 265.3.

 The application for such certificates shall include a comprehensive business plan

detailing the technical, managerial, and financial resources to be devoted to

• peration of the . . . sewer service. Virginia Code § 56-265.3.1.

 Status: Atlantic Town Center Utility Company, Inc. chartered as Public

Service Corporation.
