Existing Zoning Waverley LEP 2012  Private Recreation RE2  Existing permissible uses include Building identification signs, business identification signs, child care centres , community facilities , environmental facilities, environmental protection works, flood mitigation works, information and education facilities, kiosks, recreation areas, recreation facilities (indoor), recreation facilities (outdoor), registered clubs , respite day care centres, roads.  Note that roads are zoned as per adjacent zones

Proposed Zoning Waverley LEP 2012  Residential R3 – Medium Density permissible uses include home industry; roads; residential accommodation (all types except shop top housing and home occupation (sex services)) ; bed and breakfast accommodation; kiosks; markets; neighbourhood shops; childcare centres ; community facilities ; information and education facilities; places of public worship; respite day care centres; recreation areas; recreation facilities (indoor) exhibition homes / villages

  9. Proposal Summary  Proposed Zoning – R3 ฀ Consistent with surrounding ฀ Most existing uses remain permissible. Exceptions include “recreation facilities (outdoor)” and “registered club” ฀ Future development assessed against R3 zone objectives  Built form controls unchanged and consistent with land to north, east and south ฀ FSR – 0.9:1 ฀ Height – 12.5m  Intended Planning Outcome ฀ To allow medium density residential development on Lots 15 and 16 Section 4 in DP411.” ฀ Reflected in Concept master plan  Offer to enter into a VPA to contribute towards compensatory tennis facilities on public land as identified by Council

Key Rezoning Issues  Land use, and Conceptual built form ฀ Demonstrates how current controls could be applied if zone changed ฀ 40-45 apartments above basement parking  Traffic and car parking ฀ All car parking can be provided on site (49 spaces) ฀ A 28% reduction in current traffic generation Existing Proposed (Conceptual) 31/hr evening peak 22/hr am and pm peak 306/day 221/day ฀ Proposal reduces traffic associated with “searching” due to current lack of on-site parking

Key Rezoning Issues  Loss of Tennis Courts ฀ Council 2008 Recreation Needs Study identifies need for Courts ฀ Council identified potential sites include. ฀ Hugh Bamford Reserve, North Bondi ฀ Rodney Reserve, Dover Heights ฀ Proponent’s Community Facilities Needs Assessment confirms this but: ฀ Recognises risk of courts in private ownership ฀ Recognises need for better quality courts ฀ Recognises current planning by Council to potentially invest in Courts at Waverley Park (Waverley Park Plan of Management)

The Process and Next Steps  Lodgement (June 2013) ฀ WE ARE HERE  Report to Council – early September. ฀ REVIEW OPPORTUNITY  Gateway Determination – Department of Planning and Infrastructure ฀ Whether Proposal should proceed or not (REVIEW OPPORTUNITY) ฀ Consultation with Government Agencies ฀ Public exhibition (min 14 days) including draft VPA  Adoption by Council  Finalisation of Proposal and Gazettal (Est Second Half 2014) ฀ Execute VPA
