What is a Looked After Child?

  • A Care Order is an Order of the Court under Section 31 of the Children Act
  • 1989. It allows the Local Authority to share Parental Responsibility for a

Child and determine (after consultation) important issues affecting a child. This would include where a child should live and with whom.

  • An Interim Care Order is a temporary order until the court proceedings are

complete.

  • Parents may agree to having their child removed or ‘accommodated’ by

Children's Services under section 20 of the Children Act 1989, while an investigation and assessment is carried out. Children's Services will not have parental responsibility for the child if they are accommodated this way; the parents retain full and exclusive parental responsibility.

  • 15/38 = 40% had statements of SEN (EHCP)
  • National average for LAC last year was 15%
  • 54% Placed out of county

Promoting the education of looked after children (Statutory guidance for local authorities (July 2014)

  • This guidance must be followed unless there is exceptional reasons.

Key points

  • Education is arranged at the same time as care placement.
  • All LAC have a PEP which is part of the care plan.
  • As corporate parents local authorities should have high aspirations for the

children they look after.

  • Directors of Children's Services and Lead Members should ensure that:

  • To keep an up to date roll of LAC in school or college and collate

information relating to attendance and progress.

  • Inform Head teachers and DTs in schools if they have a LAC.
  • Ensure SW, DT, IROs, carers etc know their responsibility in

meeting the actions of the PEP.

  • High quality PEPs that focus on educational outcomes
  • That educational achievement is a priority for all who have

responsibility for promoting the welfare of LAC.

What are the changes to the pupil premium arrangements for looked after children in 2014-15? There are three main changes:

  • 1. Looked after children attract an increased pupil

premium of £1900.

  • 2. The cohort of looked after children who attract the pupil

premium is bigger and includes children looked after from the first day of care rather than only for six months

  • r more.
  • 3. Thirdly, for 2014-15 the pupil premium for looked after

children must be managed by the virtual school head in the authority that looks after them.
