Offences ¡under ¡the ¡Bribery ¡Act ¡

• Bribing ¡another ¡person. ¡
• Bribing ¡a ¡foreign ¡official. ¡
• Key ¡issue ¡– ¡a ¡new ¡offence ¡was ¡created, ¡making ¡it ¡a ¡crime ¡for ¡
• rganisaDons, ¡including ¡the ¡University, ¡to ¡fail ¡to ¡prevent ¡acts ¡of ¡

bribery ¡and ¡corrupDon ¡by ¡people ¡(e.g. ¡employees, ¡agents, ¡ contractors) ¡working ¡on ¡its ¡behalf. ¡

GiOs ¡and ¡Hospitality ¡

• GiOs ¡and ¡hospitality ¡are ¡considered ¡bribes ¡if ¡they ¡are ¡given ¡or ¡received ¡with ¡

the ¡intenDon ¡of ¡influencing ¡business ¡decisions. ¡

• You ¡must ¡declare ¡and ¡keep ¡a ¡record ¡of ¡all ¡giOs ¡/ ¡hospitality ¡received. ¡
• Do ¡not ¡accept ¡giOs ¡of ¡hospitality ¡unless ¡the ¡following ¡condiDons ¡are ¡met: ¡

1. The ¡offer ¡is ¡not ¡made ¡with ¡the ¡intenDon ¡of ¡gaining ¡a ¡business ¡

• advantage. ¡

2. It ¡complies ¡with ¡local ¡law ¡ 3. It ¡does ¡not ¡include ¡cash ¡or ¡a ¡cash ¡equivalent ¡(e.g. ¡Vouchers) ¡ 4. It ¡is ¡of ¡appropriate ¡type ¡and ¡value. ¡ 5. It ¡is ¡given ¡openly, ¡not ¡secretly ¡ 6. Examples ¡

• An ¡overseas ¡agent ¡is ¡found ¡to ¡have ¡made ¡a ¡payment ¡of ¡£3000 ¡

to ¡an ¡organisaDon ¡or ¡person ¡who ¡is ¡able ¡to ¡influence ¡a ¡student ¡ decision ¡to ¡come ¡to ¡the ¡University ¡of ¡Sunderland. ¡ ¡ ¡

• A ¡giO ¡or ¡hospitality ¡is ¡offered ¡by ¡a ¡member ¡of ¡staff ¡to ¡a ¡Borders ¡

Official ¡with ¡the ¡intenDon ¡of ¡influencing ¡how ¡they ¡deliver ¡their ¡

• duDes. ¡For ¡example ¡where ¡such ¡an ¡acDon ¡may ¡result ¡in ¡a ¡

students ¡visa ¡being ¡issued ¡with ¡greater ¡speed. ¡ ¡ ¡Even ¡if ¡the ¡University ¡did ¡not ¡know ¡about ¡the ¡payment ¡/ ¡gi= ¡/ ¡ hospitality, ¡it ¡can ¡be ¡prosecuted ¡unless ¡it ¡can ¡prove ¡that ¡it ¡ took ¡propor?onate ¡measures ¡to ¡prevent ¡bribery ¡and ¡ corrup?on. ¡

Statutory ¡Defence ¡

• The Act also creates a statutory defence

against the new offence.

• Organisations can defend themselves by

establishing that they have taken proportionate measures to prevent those associated with it from committing bribery.

Procedures ¡to ¡Prevent ¡Bribery ¡

Procedures ¡to ¡prevent ¡bribery ¡from ¡occurring ¡ should ¡be ¡informed ¡by ¡6 ¡key ¡principles: ¡

• 2. Top-­‑level ¡commitment ¡
• 3. Risk ¡assessment ¡
• 4. Due ¡diligence ¡
• 5. CommunicaDon ¡
• 6. Monitoring ¡and ¡review ¡

• Read, ¡understand ¡and ¡comply ¡with ¡the ¡University’s ¡

Bribery ¡Act ¡policy. ¡

• Disseminate ¡the ¡Bribery ¡Act ¡policy ¡to ¡everyone ¡who ¡works ¡

with ¡you ¡on ¡the ¡University’s ¡behalf, ¡including ¡agents ¡and ¡ partners ¡overseas. ¡

• Assess ¡the ¡vulnerability ¡of ¡your ¡acDviDes ¡on ¡an ¡ongoing ¡
• basis. ¡
• NoDfy ¡the ¡Director ¡of ¡Business ¡Assurance ¡if ¡you ¡believe ¡a ¡

breach ¡of ¡the ¡policy ¡has ¡occurred. ¡

ProsecuDons ¡

• 1 ¡prosecuDon ¡so ¡far ¡– ¡a ¡county ¡court ¡clerk ¡was ¡sentenced ¡to ¡3 ¡

years ¡imprisonment ¡for ¡tampering ¡with ¡court ¡papers ¡in ¡exchange ¡ for ¡money. ¡

• No ¡prosecuDons ¡of ¡organisaDons ¡– ¡however, ¡a ¡significant ¡

number ¡of ¡anD-­‑corrupDon ¡cases ¡have ¡been ¡brought ¡by ¡the ¡ Serious ¡Fraud ¡Office ¡/ ¡Financial ¡Services ¡Authority ¡using ¡other ¡ powers: ¡

• 3 ¡directors ¡of ¡Mabey ¡and ¡Johnson ¡sentenced ¡to ¡between ¡8 ¡and ¡2 ¡months ¡for ¡

making ¡illegal ¡payments ¡to ¡Iraqi ¡officials. ¡

• Aon ¡were ¡fined ¡£5.25m ¡for ¡failing ¡to ¡counter ¡the ¡risks ¡of ¡bribery ¡associated ¡

with ¡making ¡payments ¡overseas. ¡

Training ¡

The ¡creaDon ¡of ¡an ¡bribery ¡and ¡corrupDon ¡programme ¡for ¡staff. ¡ ¡This ¡ training ¡programme ¡is ¡currently ¡being ¡developed ¡and ¡will ¡be ¡available ¡in ¡ the ¡next ¡2-­‑3 ¡months. ¡ ¡ ¡ This ¡training ¡will ¡be ¡delivered ¡online. ¡ ¡ ¡ All ¡staff, ¡including ¡those ¡based ¡overseas, ¡will ¡be ¡asked ¡to ¡undertake ¡this ¡
