Reason for Rule Amendment San Joaquin Valley Air Basin is designated: • Federal NAAQS – Nonattainment for particulate matter 2.5 microns in diameter or less (PM2.5). – Extreme nonattainment for eight-hour ozone. California air quality standards Nonattainment for particulate matter 10 microns in diameter or less (PM10). – Severe nonattainment for ozone.

  9. Reason for Rule Amendment • Commitment in District’s 2007 Ozone Plan and 2008 PM2.5 Plan. • Implement control measures through the rule development process and achieve additional reductions of NOx, CO, VOC, and SOx.

  11. No Rule Changes for • Exempt engines. • Agricultural operations (AO) spark ignited engines (NOx, CO, and VOC emission limits) • Compression-ignited engine emission limits/standards. • No change to source testing and recordkeeping

  12. Summary of Draft Amendments • Change rule threshold from >50 bhp to 25 bhp or greater • Lower emission limits for – Non-AO spark-ignited engines. – Non-AO field gas fueled cyclic loaded engines. • Provision for payment of annual fees to comply.

  13. Summary of Draft Amendments • Adding a provision for only one portable NOx measurement, if the engine is operated less than 120 days/year. • Add SOx control and monitoring for Non-AO engines. • Delete existing AECP provision.

  14. Section 5.1: Requirements for Stationary Engines 25 to 50 hp Add a point-of-sale provision: Must • meet federal NSPS for the year in which the engine was last purchased. • By 7/12011, owners of small engines used in Non-AO has to submit a one- time report.

  15. Section 5.2: Requirements for Non-AO SI Engines >50 bhp • Comply with the new emission limits (Table 2 of the draft rule); or • Pay annual fees and comply with the SOx control and monitoring requirements.

Section 5.6 Payment of Annual Fee • Pay annual fees in lieu of complying with Table 2 NOx limit. • Calculated based on actual fuel used and includes all emissions, not just to rule limits. • Total annual fee includes fee rate, administrative fee, and any applicable late fee. • Fee rate (dollars/ton) is based on the cost effectiveness established in District Rule 9510 (ISR).

  18. Annual Fee Emission Calculation E = [(EF) × (AFU) × (393.2 bhp-hr/MMBtu) × Engine Efficiency] ÷ [453.6 g/lb × 2,000 lb/ton] Where: E = Annual NOx emission for each engine EF = PTO NOx limit in g/bhp-hr AFU = Actual fuel usage in MMBtu/yr Engine Efficiency = 30 percent

Alternative Annual Fee Emission Calculation E = [(EF) × (AFU) x (F factor) × (46 lb/lb-mol) × (O2 factor)] ÷ [379 ft3/lb-mol × 2,000 lb/ton] Where: E = Annual NOx emission EF = PTO NOx limit in ppmv @15% O2 AFU = Annual fuel usage in MMBtu/yr F factor = based on fuel type used O2 factor = 20.95 ÷ 5.95 (correction)

  20. Section 5.9: Portable NOx Analyzer Monitoring for Non-AO SI Engine >50 bhp • Currently requires NOx monitoring each calendar quarter in which a source test is not performed and the engine is operated. • Include a provision to conduct one NOx measurement if the engine is operated less than 120 days per calendar year instead of quarterly.

  21. Section 5.7: SOx Control Requirements • Use on PUC-quality natural gas, commercial propane, butane, LPG, or combination; or • Use CA reformulated gasoline or diesel fuel; or • Use liquid fuel with < 5 grains sulfur/100 SCF; or • Use liquid fuel with < 15 ppm sulfur; or • Use a 95% SOx emission control device.

  22. Section 5.10: SOx Emissions Monitoring • No annual fuel analysis for PUC-quality natural gas, commercial propane, butane, LPG, or combination of such gases, CA reformulated gasoline, CA reformulated diesel fuel. • Annual source test if using an SOx emission control device.

  23. Section 7.7: Table 2 Limits Compliance Schedule • 7/1/2013 – Submit ECP, I&M, and ATC • 1/1/2014 – Demonstrate full compliance with Table 2 limits

  24. Section 7.8: Annual Fees • 7/1/2013 – Submit ECP • 3/1/2014 – First annual fee payment due • 3/1/20xx – Subsequent annual fee due • Late fee applies if payment is not received by specified deadline. • Annual fee payment shall continue until: – Engine is permanently removed or – Demonstrate compliance with Table 2 limits
