  • Operation (What processes occur?)
  • Building (what does it look like?)
  • Location (Does it fit here?)

  • Grow outdoors?
  • Require Ag buildings/barns?
  • Require outdoor storage?
  • Need a farm-style rural setting?
  • Utilize farming machinery?

Access to Cannabis for Medical Purposes Regulations

Key Considerations for Planners:

  • Medicinal Marijuana Growing Facilities
  • Use Type

(Industrial, Commercial, Manufacturing, AG (at your own risk) or a new use type)

  • Appropriate Zoning

(Direct to appropriate Districts – Industrial – Business – Commercial etc)

  • Setbacks

(May already be appropriate in certain districts – increase through regulations if necessary)

Regulating Legalized Marijuana

The Proposed Ontario Model

Loosely based on existing alcohol and tobacco experiences

  • Purchase and possession age of 19
  • Possession limit of 30 grams
  • Undertaking public education campaigns
  • Prohibiting the sale of marijuana and alcohol together
  • Shutting down existing ‘dispensaries’
  • Controlled by Liquor Control Board of Ontario
  • Consumption in private residencies ONLY

How Municipalities Can Prepare

Initial Steps Recommended by the FCM:

  • Passing a motion in council directing municipal staff to prepare
  • ptions for land-use by-law amendments in anticipation of

direction from other orders of government.

  • Conducting research on the local impacts of cannabis legalization

and implications for municipal governments.

  • Engage with your province or territory through

provincial/territorial municipal associations or directly in a PT consultation process.

  • Create a timeline and work plan.

How Can Municipalities Prepare?

Start early public engagement to determine:

  • Do people want ‘weed cafes’?
  • Where should they be?
  • Should the number be restricted?
  • How far from schools and parks should they be?
  • What should the definitions say?
