Annexation Update • May 9, 2013 letter from nine Producers requesting consideration to modify the annexation policy • June 12, 2013 Water Issues Committee – staff directed to meet with Producers regarding this issue • Six meetings occurred - New proposed annexation terms have been developed • Annexation agreements incorporate these new terms • Letters attached from three applicants agreeing to the new agreements 6

  7. New Annexation Terms • Annexation applicants provide sewer flows to Orange County Sanitation District – various terms • YLWD and IRWD limit their BPP to 70% maximum for future period of time • Anaheim – no benefit from annexing for five years • No new annexations for 10 years 7

  8. Environmental Evaluation • Includes analysis of construction of 3 new wells by YLWD • Anaheim and IRWD will use existing facilities 8

Evaluation of Potential Impacts to Groundwater Basin • Evaluated potential impacts at a range of basin storage conditions (from 200,000 acre-feet to 500,000 acre-feet accumulated overdraft) • Utilized basin computer model to conduct 14 different model runs, evaluating a number of different conditions (for example, different BPPs, different amounts of assumed annexation pumping) • Modeling results used for Draft EIR 9

Example Uses of Model Results in EIR • Evaluated potential groundwater impacts with respect to changes in groundwater elevations • Evaluated if changes in groundwater elevations could impact groundwater quality • In summary, model results indicate requested annexations will not have a significant impact on the groundwater basin 10

Preparation of EIR • Prepared Draft EIR based on modeling analyses and related environmental evaluations • Draft EIR circulated for public comment on March 29, 2013 • 14 comment letters received • Conducted 6 additional groundwater basin model runs (20 total) in response to comments • 6 additional model runs and response to comments did not provide significant new information 11

Final EIR • Concludes that after mitigation, there will be no significant unavoidable adverse impacts if the OCWD Board of Directors approves the annexation applications of IRWD, YLWD and the City of Anaheim • Mitigation measures required of YLWD for construction- related issues of 3 new production wells 12

  13. Staff Recommendations 1. Certify Final Program/Project Environmental Impact Report for the Orange County Water District Annexation Request by the City of Anaheim, Irvine Ranch Water District, and Yorba Linda Water District. 2. Approving and authorizing execution of an annexation agreement with City of Anaheim. 3. Approving and authorizing execution of an annexation agreement with Irvine Ranch Water District. 4. Approving and authorizing execution of an annexation agreement with Yorba Linda Water District. 5. Authorizing filing of a CEQA notice of determination, and 6. Approve transmittal of resolution to LAFCO and directing staff to prepare the necessary documents and application to LAFCO to annex the requested areas into the District. 13
