  7. Why do plans change? The Planning Act provides authority for applicants to • submit development applications to amend the Official Plan or the Zoning By-law. The City is required to process applications. • If Council does not make a decision on an application • within a prescribed timeframe, the application can be appealed to the Local Planning Tribunal.

  11. Ontario Municipal Board/ Local Planning Appeal Tribunal • There have been recent changes to the OMB. The OMB was replaced by the Local Planning Appeal Tribunal (LPAT) on April 3, 2018. Regulations outlining this transition have been recently released. • After April 3, 2018, for approved Zoning By-law Amendments: • Any appellant must explain and demonstrate how the approved rezoning (or Any appellant must explain and demonstrate how the approved rezoning (or some part of it) is inconsistent with the Provincial Policy Statement, fails to conform with or conflicts with a provincial plan (such as the Greenbelt Plan), or fails to conform with an applicable upper-tier official plan (eg: Halton Region Official Plan). • The Local Planning Appeals Tribunal is under a statutory obligation to dismiss any appeal that fails to demonstrate this. • The important thing to note is that you must participate in the planning process in order to lodge an appeal or participate in a Hearing.

  15. Official Plan Designation � Designated ‘Residential – Low Density’ as per Official Plan Schedule B B � Proposal complies with the Official Plan policies, no amendment required.
