Ground System s Engineering Departm ent ( 1 / 3 )

 The Ground Systems Engineering Department (OPS-G) is responsible for

  • All engineering activities related to the procurement of the systems required

to support missions operations entrusted to the Directorate of Operations and Infrastructure (D/ OPS).

  • Ground Segment design and technology evolution
  • Engineering support to mission operations in all phases of the missions and

the ground systems life cycle: Mission Control Systems, Simulators, Flight Dynamics, Space Debris and Navigation.

  • Operations support in the area of Flight Dynamics
  • Support to ESA and Third party missions in the areas of expertise
  • Overall technical standardisation policy and coordination for the ground

Objectives and Motivation

 Opening the competition on manpower FCs currently in place for Ground Segment Engineering (MCS and GS)  Consolidation of divisional manpower support FCs at OPS-G level  Extend Manpower FC to cover all the disciplines in OPS-G  Establishment of a mechanism to recruit contractor staff that is:

Relation to GFC8

 Ground Systems Software Related Activities (GFC8)

  • The GFC8 contract covers development and maintenance of

[ software] products in the OPS-G application domains. It also includes operations of the products developed within the contract. Specific service requirements are included for support of the simulation campaigns, Navigation office operations and Space Debris tool operation.

  • EFC1 activities are not aimed primarily at developing software

(although development of algorithms or some engineering software tool activities might be carried out) and include also Ground Station engineering support

  • In GFC8, both FFP and FUP activities are considered. Development

and maintenance activities will, by default, be FFP. FUP support will be used for mission preparation, launch preparation and operational phases.

  • EFC1 activities will generally be carried out as FUP
  • Development activities in GFC8 shall be performed normally off-
  • site. Work shall be performed on ESOC site only for: work needed
  • n ESOC specific platform for longer than 6 months period or on-

site support work for member of operational teams and Helpdesks.

  • EFC1 activities will generally be carried out on-site ESA sites

Tendering rules

 Consortium building constrains

  • Consortia, which include more than one large manpower provider

to ESA in whatever capacity (Prime or Sub). A “large manpower provider” is deemed to be a company having presently under an existing manpower support contract with the Agency in whatever capacity – being prime- or subcontractor – more than 50 man- years per year of contractual commitment during the Contract duration.

  • Competing Prime contractors in current manpower frame contracts

in the same Application Domain cannot build consortia (see clarification issued)

 Put in place competitive FCs with a duration of 3 (+ 2 optional) years, to cover all new requirements arising as of 2011  Due to delays in issuing the I TT and the need to present the Contract Proposal to I PC, the FCs are not expected to be kicked-off before 1 st April 2 0 1 1 .  Transition of all ongoing OPS-G manpower contracts to the FC upon expiration.  Procurement of future contractor manpower support services within the EFC1 Frame Contracts in a competitive way.

 Following the trend already initiated by this and other ongoing procurement actions towards the consolidation of the D/ OPS manpower frame contracts, it is the intention to assess, in the timeframe 2013-2014, the possibility of integrating the manpower contracts at a directorate level, taking into account the experience gathered until then in this type of contracts and the specific needs of the different technical domains.

 Question:

  • During the industry day for GFC8, it was explained that the Agency intends to

have competitive manpower support contracts for OPS-G providing staff to carry out activities typically assigned to permanent staff (ESA staff) referring to all OPS-G disciplines. A specific point was made that this was not intended to perform industrial work (refer to GFC8 Info Day presentation / 03/ 04/ 2010 / Page 7 – attached below). Given the EFC ITT, with respect to Astro-Dynamics, the work package descriptions, including the explanation given for the Intended WPs seems to contradict the above. Can the Agency therefore confirm that the work foreseen in the Astro- Dynamics Domain will not overlap with the industrial work to be carried out under GFC8 for Navigation and Flight Dynamics currently out for tender under RFP-02-03.

Answ er:

  • The EFC1 Astro-Dynamics tasks are identified in a generic way in Chapter 4 of the

Work Statement and are fully in line with the intentions announced during the GFC8 industrial day. The scope of EFC1 covers a wide range of activities (as described in page 9 above); a strict separation of activities between the two types of contracts is therefore not always possible without jeopardising the integrity of the teams. “Industrial work” was meant to describe work that predominantly focuses on development of software products. The WPs in EFC1 are not aimed at this, though may include activities related to software tools, like maintenance, upgrade, algorithm implementation, configuration control etc. along with other engineering tasks.

  • The WPs tendered in the GFC8 Flight Dynamics RFP 02 are valid for 2011 and during

this time no work is foreseen for Flight Dynamics nor Navigation in EFC1 (except for new positions that might be identified in line with EFC1 objectives). After 2011, the tasks in this domain might be re-structured in those that are within the EFC1 scope and those that fit within the GFC8 scope.

  • How will the potential companies’ conflict of interest between the two frame

contracts (GFC8 and Eng Manpower) be applied in practice? E.g. will a restriction apply for a whole application domain or on a case by case basis, per specific RFP?  Answ er:

  • The intention is to avoid the conflict of interests on a case-by-case level,

avoiding that the same company is on both sides of the customer supplier interface in a specific development. Also on the side of the contractor staff there are obligations to raise any possible conflict of interest (see contract appendix 6b, regarding conflict of interests)  Question:

  • How much of the manpower intended in table in annex D of the SoW is new

and how much is planned to be transferred from GFC8 or the on-going contracts?

  • Do you foresee a future potential transfer of activity between GFC8 (FDS

Services) and this Manpower Support Engineering frame contract?  Answ er:

  • The figures given for “intended” work in the ITT are only indicative. The real

figures are not known. They will depend on the number of new requests for support (cannot be anticipated at the moment) and on a possible restructuring of the work envisaged under GFC8 to be assessed.

  • We understood from previous discussions that this frame contract

could potentially be, in the future, regrouped with OD8. Could you please confirm that we have the correct understanding? As some of the FCO on GFC8 are involved in the OD8 frame contract, which impact would you then foresee on the future participation of FCOs to a future global ESOC - manpower support frame contract ?  Answ er:

  • The possibility of combining OD8 and EFC1 into one manpower

contract in three year’s time will be assessed and if considered advantageous will be implemented. At this time, also the approach to development and maintenance FC might be redefined and thereby the relationship between those and the manpower contract.

  • This is allowed, however, this should not result in any increase of
  • verheads; e.g. whether one consortium or several consortia, there

should be only one contract between the Agency and the FCO.  Question:

  • Could you precise if the Agency could award a consortium

composed of several companies presenting some overlaps of domains (for example Company A covering Activity Domains X and Y while Company B would cover Activity Domains Y and Z)?  Answ er:

  • Yes, this would be perfectly in line with the expectations of the

Agency.

  • Yes, the Agency wants to base the evaluation of FCOs also on the

proposals for WPs where there will not be immediate allocation of work as part of this ITT (also called “intended” and showing workforce request of 0). In order to carry out the evaluation, the Agency is requesting CVs for all WPs (initial and intended).

  • ..the Navigation Systems domain WPs: they are all intended to be
  • ccupied by senior staff. How can university institutes like us who

can provide young and qualified scientists, but not seniors, be involved, like it is possible in the current Navigation Support Office (NSO) FC? Our staff are usually fresh academics motivated to do research-like work, we do not have permanent positions and thus seniors (with few exceptions only, but those can contribute on short term basis only, e.g. for consultancy and scientific studies). Maybe a statement from NSO would be helpful?  Answ er:

  • It is confirmed that indeed all but one Navigation positions will

require “normal” experience engineers (reference is made to the table above, indicating the experience requirements, that supersede the ones in the SoW). Junior engineers can be considered for development and maintenance tasks, e.g. in the frame of GFC8.

 Question: (SOW, 8.8 Invoicing: … . Thus, no advanced payment is foreseen, payments are meant to be done quarterly, in arrears.) I presume that this really means invoicing, not payments, to be done quarterly in arrears. The result will be that, with a 30 day payment period and the frequent, serious delays that have been introduced with the SAP accounting system, companies cannot expect payment until sometime in the fifth, possibly sixth, month. This will require even the most financially robust company to use credit lines with financial institutions. If the Agency will not agree to payments in advance then: 1.Will the Agency please confirm that the significant costs associated with financing up to six months of services before payment may be passed on to the Agency or at least be included in the Financial Proposal as overheads? 2.Will the Agency also please confirm that upon request it will provide letters for financial institutions that guarantee the Agency’s solvency and financial backing by the member states?

  • The Agency makes reference to Clarification No. 1 published on

EMITS on the 20 August 2010: the contracts listed therein replace the list of contracts published in the above referenced section of the

  • STC. The Agency will provide the name of each of the contracts as

well as the prime contractors however cannot provide the names of

  • subcontractors. The latter are not relevant concerning the
