What is the Pre-employment Screening Program (PSP)?

♦ New FMCSA Program

  • Enrollment – March 2010
  • Full Release – May 11, 2010

♦ Provides motor carrier employers with crash and inspection information on potential new hires ♦ Voluntary for both carriers and drivers ♦ Driver must provide written consent

Why did FMCSA develop the PSP?

♦ Required by SAFETEA-LU ♦ Increase safety ♦ Better informed decisions on new hires ♦ Improves data quality

What data is in the PSP?

♦ Motor Carrier Management Information System (MCMIS)

  • 5 years crash data
  • 3 years inspection data

♦ Does not include conviction data ♦ Same as FMCSA’s Driver Information Resource (DIR)

How does the PSP work?

♦ Secure electronic, Web-based system ♦ Fee for service by contractor (see website for rates) ♦ Motor Carrier enrolls, collects signatures from applicant drivers (FMCSA audits to assure signature collection) ♦ Driver can bring own PSP record or motor carrier can obtain through PSP system

Can the driver see their profile?

♦ YES, and we encourage you to do so! ♦ Currently available via Freedom Of Information Act (FOIA) from FMCSA ♦ Available through PSP system ♦ Can Request a review of the data through FMCSA’s DataQs System https://dataqs.fmcsa.dot.gov/login.asp

How will FMCSA protect the data?

♦ Data handling must adhere to:

  • Privacy Act
  • Non-Disclosure Statements
  • Fair Credit Reporting Act
  • All Other Applicable Federal Laws

♦ Protections against theft, manipulation, etc. ♦ FMCSA audits ♦ Process confirms driver and company identity ♦ Contractor cannot change data

Motor Carrier Enrollment

♦ Motor carrier enrollment will authenticate company and provide credentials ♦ Motor carriers must agree to all legal and usage constraints and warnings each time they begin a session ♦ Functions:
