  3. Purpose of today’s meeting • To discuss proposed terms and conditions for the transfer of employees to DoT on July 1 • We are not discussing the design work that is being undertaken separately in three stages and this will have its own consultation process. 3

  4. What happens on 1 July 2019? • All employees (other than R&L and Heavy Vehicle Services) will transfer to DoT and consequently be covered by the Victorian Public Service (VPS) Agreement • Executive Officers (EOs) will also transfer to DoT and continue to be covered by their individual contracts of employment • R&L and Heavy Vehicle Services remain part of the transport portfolio and report into the Department but employees remain on VicRoads EA8. 4

  5. Transfer arrangements for employees to DoT on July 1 • The legal mechanism for the VRO/STS employee transfer will be s.66N of the Transport Integration Act 2010 and Public Administration Act 2004 • These require that employees transfer on terms and conditions that are 'no less favourable overall’ than those that applied to the employee immediately before the transfer date. 5

What does ‘no less favourable overall’ mean? • ‘No less favourable overall’ means comparing terms and conditions in EA8 against the terms and conditions contained in the VPS EA 2016 • This comparison is undertaken as an overall assessment of the key differences in the agreements • An employee transferring must be on terms and conditions that are ‘no less favourable overall’. 6

What are the proposed terms and conditions for my transfer? • You will transfer on your existing salary and the progression entitlement associated with your current substantive classification • Those who are top of band retain access to the 4 per cent top-of- grade bonus in the annual performance cycle • You will retain your continuity of service and any accrued leave entitlements. You will not be entitled to leave loading • You will retain your existing flexible work arrangements for the period agreed and existing review arrangements will apply (more) 9

What are the proposed terms and conditions for my transfer ( continued )? • You will retain existing overtime eligibility • You will continue to be entitled to the 40 per cent public transport subsidy • If you are an appointed First Aid Officer with a current certificate you will retain the current first aid allowance. 10

How will these proposed terms and conditions be carried forward? • Each employee will be provided a letter of engagement which details all the unique terms and conditions that will be preserved for transferring VicRoads employees • All other terms and conditions not outlined in the letter will be provided by the VPS agreement 11

  12. Why this approach to transfer employees? • Ensures the ‘no less favourable overall’ requirement is met by: - continuing the employee’s current salary - preserving progression / top of band bonus - preserving other unique terms and conditions • This was previously used for the transfer of VicRoads employees to Transport for Victoria 12

  13. What happens if I secure a new position within DoT after 1 July 2019? • The terms and conditions contained in your letter of engagement apply to you in the position you transfer into on 1 July 2019 • Should you move into a new position within DoT or the broader VPS, permanently or on secondment post 1 July 2019, then you will be offered the position under the terms of the VPS agreement • This will replace your letter of engagement on transfer. 13

  14. How are different employment arrangements impacted? • Ongoing employees will be transferred as ongoing employees • Fixed term employees will transfer on fixed term contracts until the end of their fixed term contract • Existing Agency / Contractor engagements will continue as per the terms of their engagement • Existing internal VicRoads secondment arrangements will continue and will be managed in the accordance with current arrangements 14

  15. Will I get my CDP progression / bonus for 2018-19? • Yes, providing you meet the requirements in your CDP you will be eligible for the 2018-19 annual progression / bonus • These outcomes for 2018-19 will be notified and processed in accordance with the usual timeline, in September to October 2019 • Managers and employees are encouraged to complete the 2018-19 CDP review in a timely manner after 30 June 2019 • Beyond 2018-19 VicRoads employees transferred to DoT will participate in the VPS equivalent CDP program and retain eligibility to progression or top of band bonus at 4 per cent. 15

Timeline for transition to DoT 13 May Consultation commences with employees, employee representatives and unions 24 May Closing date for feedback on the proposed terms and conditions of transfer 27 May to Feedback considered and responded to 7 June By 28 June Final terms and conditions advised to employees via letter 1 July Transfer of VicRoads employees to DoT 16

  17. Summary • On 1 July 2019 all VicRoads employees will transfer to DoT on terms and conditions ‘no less favourable overall’ except - Heavy Vehicle Services - Registration and Licensing employees • Proposed approach - to achieve ‘no less favourable overall’ requirement - is to provide employees with a letter of engagement confirming the terms and conditions they will retain • Consultation is now open and we welcome your feedback • Employees on leave will be contacted and invited to provide feedback. 17
