Supplier Responsibilities

The supplier shall, at any stage of the supply chain, comply with the following:

Shall have a valid trade/industry license Obtaining the UAE Quality Mark according to the procedures adopted by the Authority Ensuring the continuous conformity of the product after obtaining the EQM certificate of conformity Complying with Organic Regulation is the product is labelled as organic Cooperating with the Authority and the competent authority by providing all documents, conformity certificates and any other documents related to the product, upon request

Cooperation with the Authority and competent authorities to withdraw the product that does not meet the mandatory standard specifications from the market and reporting any product that may be provided and which violates the provisions of this resolution.

Conformity Assessment Requirements

• 1. It is prohibited to import or offer a product without EQM Certificate of

Conformity, license to use the EQM and the EQM Logo on the product.

• 2. For the purpose of the conformity assessment of the product to the mandatory

standard specifications, the following must be verified  Ensuring that the product meets all the requirements of this decision. Submitting certificates to the Authority confirming the supplier's commitment to implement any of the applicable quality management systems globally and that is accepted by the authority, in addition to the application of any food safety management systems or good manufacturing practices (GMP) that are universally accepted and that is acceptable to the Authority.

Conformity Assessment Requirements

Compliance of the product label to the UAE S. GSO standards Commitment to the Cabinet Decision on the UAE Food contact tools control System. Transport and storage of the product in accordance with the requirements stated in the approved standard specifications specified in the table attached to this decision. Commitment to the decision of the Council of Ministers relating the UAE system for Halal products control.

Conformity Assessment Requirements

Control and Market Surveillance

The Authority or the competent authority shall, as the case may be, control the product in the markets to ensure that the conformity certificate is maintained throughout all supply chain, it shall take any of the following measures:

Inspection, sampling of the product and testing them Ensuring that all outlets in the UAE are committed to ban the importation or placing of the product in the local market only after obtaining the certificate of conformity Taking appropriate measures against the product that does not meet the conditions of granting a certificate of conformity or which loses any of these conditions including suspension of trading, withdrawing the product that is not identical from the local markets

The Authority or the competent authority shall, as the case may be, control the product in the markets to ensure that the conformity certificate is maintained throughout all supply chain, it shall take any of the following measures:

What is the design of the Mark?

What is the color of EQM? The logo shall be reproduced in the national flag colours of UAE what is the Size of EQM? 3.0mm X 1.5mm minimum size (2:1 ratio)

General Rules for EQM

1. After obtaining the Certificate of Conformity, the licensee shall use the Emirates Quality Mark on the certified products. 2. The licensee shall use the mark for sales promotion for the product. It may be used in advertisements and on stationery together with the logo or the name of the manufacturer or the licensee provided that it is not used in such a manner that ESMA may consider as misleading. The EQM Logo may be used on the following:

• Principal display panel of the certified products
• Secondary or tertiary packaging whichever is directly visible to the buyer during display
• Company publicity materials such as brochures, company profiles, reports, exhibition materials, flyers,

banners, roll-ups etc

• Corporate electronic media such as in website, internet etc
• Internal walls and doors of the factory/offices
• Company vehicles
• Company communication documents such as letterheads, stationeries etc

The supplier shall, at any stage of the supply chain, comply with the following:

Technical requirements

The product prepared for the purpose of offering or trading within the State shall meet the following:

• Requirements of the approved standard specification (UAE.S GSO 9).
• The explanatory data on the statement card shall meet the requirements of

the standard specification stated in the table attached to this resolution.

• The images and phrases used on the packaging in which the product is

placed, shall not violate the public order, public morals and Islamic values prevailing in the State.

• The conformity of the quantity in the package to the requirements stated in

the relevant approved standard specification, as shown in the table attached to this resolution.

• Packing it in suitable containers in terms of health that does not affect its

properties and it should comply with the requirements of the approved standard specifications set out in the table attached to this resolution.

• The validity periods shall correspond to the requirements set out in the

relevant approved standard specifications, which are set out in the table attached to this resolution.

Technical requirements

Conformity Verification

The Authority and the Competent Authority shall, as the case may be, prior to granting the product a EQM certificate of conformity to verify its compliance with the approved standard specifications specified in this resolution, including the verification of the following:

• The product meets all the requirements of this resolution and conforms to the

approved standard specifications

• The supplier effectively applies the food safety system in the factory and that he

has submitted certificates confirming that, issued by recognized authorities.

• All technical documents, certificates and all data and information, confirm the

conformity of the product to the requirements of this resolution

About ESMA Market Surveillance

Surveillance Department is responsible in performing / coordinating market surveillance activities across the country covering the products that are regulated by ESMA in order to insure that all of the products in UAE are complying with the regulations that will enhance both quality and safety aspects of the products thus increasing the level of community happiness

In order to effectively plan for the implementation of the ESMA strategy, ESMA must ensure effective surveillance of UAE markets. ESMA commits:

• 1. To help protect consumers against unsafe products and general non-compliance
• 2. To help protect businesses from unfair competition by those who fail to comply with the regulations
• 3. Ensure effective implementation of ESMA regulations by confirming compliance of products in the UAE

market

• 4. Products placed on the market are monitored
• 5. The marking and green Labelling and documentation requirements have been respected
• 6. Products have been designed and manufactured in accordance with UAE regulations requirements

ESMA Market Surveillance Objective

There are (3) distinct types of surveillance based on the critically of the item being reviewed and those types are the following:

• 1. G1: Sample collection from the market and submitting it for laboratory testing (Full

testing)

• 2. G2: Sample collection from the market and submitting it testing laboratories for

verification on specific parameters

• 3. G3: Visual inspection of the product
