  4. Air pollution and health Road traffic-related air pollution is a major source of preventable air pollution affecting everyone’s health Air pollution (including fine particulate matter (PM2.5 and PM10) and nitrogen oxides (NOx) is bad for health and shortens life-spans for everyone. Impact on the very young and old, and those with existing respiratory and cardiovascular conditions (esp. heart disease and respiratory illnesses). Health inequalities and social justice issue

  5. Air Quality in Scotland • Transport emissions contribute to over a third of nitrogen oxide emissions in Scotland. • In 2010, the UK Government Department of Health’s Expert Advisory Committee, the Committee on the Medical Effects of Air Pollution (COMEAP), estimated that poor air quality shortens average life expectancy in Scotland by three to four months (compared to six to seven in England and Wales), and vulnerable groups are disproportionately affected (Health Protection Scotland, 2014). • Currently, no nationally consistent standards for LEZs exist, which explains in part why no Scottish local authority has ever implemented a LEZ.

  6. • Introduce Low Emissions Zones (LEZ) into Scotland’s four biggest cities between 2018 and 2020 • LEZs into all other AQMAs by 2023 where NLEF appraisals advocate such mitigation • Promote the use of ultra-low emission vehicles (ULEVs), with a target to phase out the need for new petrol and diesel cars and vans by 2032 • Create Scotland’s first ‘electric highway’. • Doubling of active travel budget • Introduce Europe’s most comprehensive network of cutting-edge remote sensing air quality monitors on local and trunk roads • To help those who will have the most difficulty in making the transition, will create a Low Emission Zone Support Fund

  7. Definition of a Low Emission Zone in Scotland? “…individuals driving vehicles which • Penalty scheme fail to meet specified emission standards will be prohibited from = Scottish LEZs driving those vehicles in the designated geographical area. • Charging scheme Where a person breaches this rule, = English CAZs a penalty charge will be payable unless the vehicle is exempt .” http://www.parliament.scot/S5_Bills/Transport%20(Scotland)%20Bill/SPBi ll33ENS052018.pdf

  8. “Building Scotland’s Low Emission Zones” Consultation • Consultation paper sets out the proposed arrangements and options to deliver consistent, well-designed and managed LEZs in Scotland. • Open for responses Sept – Nov 2017. • In total, 967 responses were received • There was a high level of consensus among respondents with 95.5% supporting the principle of LEZs to help improve air quality in Scotland

  9. LEZs in the Transport (Scotland) Bill

  10. Scottish Parliament scrutiny of LEZs

  11. A Scottish Government spokesperson said: “As we set out in the Programme for Government, the need for the Scottish Government and the Scottish Parliament to process Brexit legislation meant this might have an impact on the legislative programme . As a responsible government – and in the absence of the UK Government ruling out the possibility of No-Deal - Scottish Ministers are taking action to deliver a functioning statute book ahead of exit day. The deferral of a few bills are unconnected to the Budget and were discussed with the parliamentary bureau and agreed in conjunction with relevant committee Conveners. It is highly regrettable that Brexit is impacting on our priorities in this way. We remain committed to the delivery of our ambitious legislative priorities, once this period of intense Brexit activity has passed. ” Aim for Stage 2 before summer recess (June 2019) – Recess 30 June to 1 September

  12. LEZ objectives The LEZ scheme objectives must include an objective of contributing towards meeting the air quality objectives prescribed under section 87(1) of the Environment Act 1995 (regulations about air quality). Objectives met ≠ LEZ revoked

  13. NLEF and powers to appraise an LEZ Air quality-focused, evidence-based appraisal process Las to consider transport related actions to improve local air quality where transport is identified as the key contributor to air quality problems PfG - LEZs into all other AQMAs by 2023 where NLEF appraisals advocate such mitigation https://www.gov.scot/publications/national-low-emission-framework/

  14. LA powers to make a LEZ: local authority may: • make a LEZ scheme for all or part of its area (including trunk roads) • amend or revoke LEZ scheme made by it • two or more local authorities can act jointly to make a LEZ

  15. Required content of a scheme • Scheme objectives • Area on a map • Scheme may not • Specifying the specify a private roads road or special road • Date when the scheme comes into • Duration of grace effect periods

  16. Ministerial approval A low emission zone scheme cannot be made, amended or revoked unless the proposal to make, amend or revoke the scheme is approved by the Scottish Ministers.

  17. Operating hours

  18. Emission standards National consistency of emission standards. “Although the specific emissions standard will be set by regulations and is not specified in the Bill, it may be a reasonable assumption that this will be consistent with the general leading emission standards for low emission zones established in Europe – presently Euro VI/6 for diesel vehicles and Euro 4 for petrol vehicles ” To be set out in Regulations…

  19. Grace periods The grace period applicable to non-residents must expire: • not less than 1 year after it begins, and • not more than 4 years after it begins. The grace period applicable to residents must expire: • not less than 1 year after the expiry of the grace period applicable to non-residents, and • not more than 2 years after the expiry of that period.

  20. Enforcement and detection Insert detail in here Regulations will focus on approved devices and penalty method of issue, timings and manner of payment of a penalty + reviews and appeals

  21. Penalties Only one penalty charge notice in the same day per LEZ to the registered keeper DVLA record certifying a vehicle’s emission standard is determinative Fine not exceeding level 5 on the standard scale (+ surcharge option)

  22. Exemptions 1. Nationally consistent National consistency as exemptions to be set by we consider options Regulations including: • Emergency services • Military 2. Granting and renewal of a • Blue Badge Holders time-limited exemption by the • Historic vehicles LA – maximum period for such • Specialist vehicles exemptions must be no longer • Etc… than 1 year.

  23. Glasgow Scotland's first low emission zone, covering Glasgow city centre commenced on 31 December 2018. LEZ is being phased in and to start with, will only apply to local service buses. This will apply to 20% buses from the launch date, increasing to 100% by December 2022. On 31 December 2022 when the LEZ is fully implemented, all vehicles entering the zone will need to be fully compliant.

  24. Other LEZ Cities Edinburgh • Currently working to identify their proposed LEZ option. Dundee & Aberdeen • In the early stages of developing their LEZs …
