Ordinance Background

  • Since 2000, State law (AB 939)

requires jurisdictions (counties, cities) to divert 50% of their waste stream from landfills (reduced or recycled).

Ordinance Background

  • SWA Board adopted an amended

Recycling Ordinance in May 2009 that now includes Multi-Family complexes.

  • “Multi-Family” complexes include:

– Apartment Complexes – Mobile Home Parks – Senior Housing/Care Facilities – Condo Complexes, Townhomes – Multi-Storied Residential Units

  • Responsibility for program implementation

and enforcement was delegated to EMD.

Multi-Family Recycling Ordinance Requirements

  • Requires all Multi-Family complexes with

five or more units, or single family residential properties managed by an association or other organization, subscribing to 10 cubic yards or greater

  • f weekly garbage collection service, to

have a Recycling Program which is 30%

  • f total waste stream capacity.
  • Whoever contracts for garbage service is

the Responsible Party to provide a recycling service.

  • Keep designated recyclables separated from

garbage (A.K.A. “Source Separated”).

  • Subscribe to a basic level of recycling service.
  • Have written service agreement with an authorized

recycling service.

  • Property Owner/Property Manager’s responsibility is

to notify and instruct tenants on recycling program.

Exempt Multi-Families

  • Multi-Family complexes within City limits of

Citrus Heights, Elk Grove, Folsom, Galt, Isleton and Rancho Cordova.

  • Multi-Family complexes with less than 5 units or

subscribe to less than 10 cubic yards of garbage/week.

Inspections

  • Initial focus on large generators.
  • Site visits.
  • We will need a few minutes of your time during

the inspection (Property/Site Manager, Maintenance Supervisor, or Point Person).

  • 60 days for a facility to address Areas of

Concern.

REMEMBER:

Outreach and education is a continual,

  • n-going process. Constant education

and follow-up with tenants is key to implementing a successful, on-going recycling program.

SUMMARY

  • Recycling must be provided to tenants if

you have 5 or more units and 10 or more yards of garbage service per week.

  • 30% of capacity must be dedicated to

recycling.

  • Total yards of trash available at site X .3

= minimum amount of recycling needed.

responsible for implementing recycling service and program.
