Mining Projects are regulated under the

  • Mineral Resources (Sustainable Development ) Act

1990 (Vic)

  • Mineral Resources (Sustainable Development)

(Mineral Industries) Regulations 2013 (Vic) 3 licence types – Exploration licence – Retention licence – Mining licence MINING PROJECTS

  • Exploration Licence – allows the licensee to explore for minerals

in the licence area. This may involve soil sampling, geophysical surveys (ground or airborne) or drilling.

  • Retention Licence – allows the licensee to retain rights to a

mineral resource that is not currently economically viable or for the purpose of sustaining an existing mine. Work undertaken on an RL may include drilling, undertaking feasibility studies including Environment Effects Statement (EES) and other studies required to ‘prove’ a mineral resources is feasible for mining.

  • Mining Licence – allows the licensee to extract minerals for the

purpose of commercial production as well as construct any facilities specified in the licence and anything else related to that mining activity. Work includes detailed design, mining work plan, site construction, mining operations.

  • An application for a mining licence must contain the

information set out in Schedule 3 of the MRSD(MI) Regulations including:

  • ‘Fit and proper person’ test
  • Evidence of technical qualifications and experience of proponent
  • A map of the proposed licence area
  • Estimates of annual expenditure
  • Evidence of financial capability to undertake the proposed work
  • Details of the proposed work program
  • The granting of a licence is not an approval to commence work (i.e.

mining activities)

  • The components of a work plan are detailed in Part 1

Schedule 15 of the Mineral Resources (Sustainable Development) (Mineral Industries) Regulations 2013.

  • Mining activity cannot commence on a mining licence

until a work plan is approved by the department head (delegate)

  • A work plan contains several parts including:
  • Description of the work
  • Identification of mining hazards
  • Identification and assessment of risk
  • Risk management plan
  • Rehabilitation plan
  • Community engagement plan

  • A work plan may also include items as prescribed by

an EES process.

  • A work plan maybe referred to other relevant

departments and authorities for assessment and comment – this may result in conditions.

  • A cultural heritage management plan (CHMP) and
  • ffset management plan could be required (if deemed

necessary by referral authorities)

  • Work plans are not public documents

  • Work cannot commence on a mining licence until the

licence holder has:

  • An approved work plan
  • Entered into a rehabilitation bond
  • Obtained all other consents and authorities required by law

(e.g. a planning permit)

  • Complied with environmental offset conditions
  • Obtained public liability insurance
  • Obtained consent or entered compensation arrangements

with the owner and occupier of any private land to which entry is required

  • Given at least seven days notice to the Chief Inspector and
  • wners and occupiers of land to which entry is required.

  • Some works are permitted under a licence without the

need for a work plan or planning permit – low impact drilling (exploration)

  • These work must follow the approved Code of Practice

published on the department’s website

  • The Code of Practice covers works that are considered

consent – compensation

  • Dispute process where consent /compensation is not
