Majority posi+on – Single Tier of Protected Informa+on The UTSA preempts common law claims arising from the same facts as a trade secret claim. UTSA claims represent the exclusive tort remedy for allega5ons that a party misused non‐public business informa5on. Minority posi+on – Second Tier of Protected Informa+on Overlapping common law tort claims are available for a informa5on cons5tu5ng a failed trade secret claim.
