The Department of Community Planning and Economic Development recommends that the City Council adopt staff findings for the application by Rich Lewis for the property located at 825 Nicollet Mall: A. Waiver of Restrictions of Interim Ordinance. Recommended motion: Approve the application for a waiver

• The applicant has cited the inability to sell menthol tobacco as a

hardship to successful operation of the business

• Staff has not identified any characteristics of the submitted

hardship application that are not shared equally by all convenience store owners subject to the interim ordinance

• The moratorium was created to prevent the proliferation of new

tobacco products shops

• There will likely be a tobacco policy adopted before the tobacco

moratorium expires that will guide where new tobacco products shops can establish in the City of Minneapolis

• The proposal to establish a new tobacco shop before the adoption
• f such policy may undermine the planning process
