1 mile Pool Buffer Discovery Well: State NPA #1 Scharb Bone Springs Oil Pool Rules - Order R-2589 (10.30.1963):
- 80 acre spacing units
- Secretary Director may grant an exception to 80 acre spacing requirement without notice or hearing when an application for a non-standard unit comprising 40 acres,
more or less, has been filed if no objections from offset affected parties occur within 30 days of receipt of said application
- The first well drilled on every standard or non-standard unit in the Scharb Bone Springs Oil Pool shall be located in the NE/4 or SW/4 of a governmental quarter
section, and all wells shall be located within 200 feet of the center of a governmental quarter-quarter section
- A standard proration unit (79-81 acres) shall be assigned an 80 acre proportional factor of 5.67 for allowable purposes - 80 acres x 5.67 = 453.6 bbl of oil daily
allowable per 80 acre standard proration unit Order - R-2589-C (04.13.1983):
- Amended Rule 4 of Order R-2589 so that wells may be located in either quarter-quarter section in the proration unit provided any well complies with 200 foot setback

NEW TERMINOLOGY
15
- Project Areas, Penetration Points and Producing Areas are
Dele leted.
- “Horizontal Spacing Units”: the spacing unit dedicated to a HZ
- well. (“HSU”)
- First and Last Take Points Identified:
–FTP: : “the shallowest measured depth of the –wellbore.” –LT LTP: “the deepest measured depth of the wellbore.”
16
NEW TERMINOLOGY
17
- Tract
ct means “a legal subdivision of the United States public survey substantially in the form of a square or rectangle.”
- Uni
nitized ed A Area ea means “any area where ownership of production from relevant pool or formation is consolidated pursuant to an agreement, whether voluntary and filed in the county land records, or approved by federal or state authority…”
- Infill H
l Horizontal W Well ll means “a horizontal well the completed interval or intervals of which are located wholly within the horizontal spacing unit dedicated to a previously drilled horizontal well completed in the same pool and that the operator designates as an infill horizontal well on form C-102.”
REVISED DEFINITIONS
18
- “Affect
cted P d Persons” (19.15.2.7(A)(8)) means: – The operator, or – Each working interest owner, or – Each mineral interest owner, and – BLM and/or SLO (if applicable).
- “Min
ineral I Interest O Owner” means: “a working interest owner, or an owner of a right to explore for and develop oil and gas that is not subject to an existing lease.”
- “Prorat
atio ion U Unit it” means: the area in a pool that can be effectively and efficiently drained by one well… (deleted language: “All proration units are spacing units but not all spacing units are proration units.”)
- “Royalty I
Interest Owner” means: “the owner of an interest in oil and gas that does not presently entitle the owner to explore, drill or otherwise develop those minerals.”
STANDARD HSU
19
- Comprised of one or more contiguous tracts that the well’s
completed interval penetrates.
- Perimeter is substantially rectangular (unless intended to
stair-step for a transverse well).
- May include adjoining tracts if the lateral is within 330 feet
- f adjoining tracts.
- Must contain minimum acreage required by special pool
rules.
- No density restrictions.
DUAL SPACING
20
- Oil wells – 330 feet from outer boundary of spacing unit and
100 feet from first and last take point.
- Gas wells – 660 feet from outer boundary of spacing unit
and 330 feet from first and last take point.

SPACING AND WELL DIRECTION
29
NON-STANDARD HSUS
30
- Administrative approval after application, notice
and opportunity for hearing.
- Process is same.
31
NO STRANDING
32
- No more “stranding” - No longer required to
include 4th quarter-quarter.
- Every well may have its own spacing unit –
unless it is an infill well.
- Overlapping spacing units allowed.
CONSENT REQUIREMENTS
33
- Can’t file an APD or start drilling until:
–At least one lessee or unleased MIO has consented or –Parties have been force pooled.
STATE, FEDERAL OR TRIBAL LANDS
34
- If the HSU includes State, Federal or Tribal
Minerals, send a copy of C-102 to SLO or BLM.
MULTILATERAL WELLS
35
- Multiple laterals in same pool or formation and located
entirely within boundaries of existing HSU may be dedicated to same HSU.
MULTILATERAL WELLS
36
- A separate spacing unit is designated for each lateral if not
in original HSU.
NO ALLOWABLES OR GOR
37
- The allowable is equal to the amount the well is capable of
producing.
- No limiting Gas-Oil Ratio.
UNORTHODOX WELL LOCATION
38
- If the well location is projected or as-drilled closer to the
- uter boundary than allowed, the applicant notifies the
affected person “in each adjoining spacing unit in the same pool or formation…”
- If an adjoining tract is not included in a spacing unit in the
same pool or formation then shall notify:
- Affected persons in adjoining Q-Q section or
- Adjoining Q section (if SU is greater than 40 acres)

43
TOLERANCE CLARIFIED
44
- If the completed interval is more than 50 feet from its
projected location and closer to the outer boundary of the HSU than allowed, then must seek NSL.
- If variance is 50 feet or less, the district office may approve
the as-drilled location.
- If well has previously-approved NSL, a new NSL is needed
when completed interval is closer than the lesser of: 50 feet
- r 25% of previously-authorized distance.
45
POTASH NON-STANDARD LOCATIONS
46
COMPULSORY POOLING
47
- Pooling efforts remain the same EXCEPT:
– No longer required to form a Non-Standard Spacing Unit. – No longer required to notify operators adjoining the project area (aka spacing unit).
- Did not address risk penalties—full development of acreage,
effect on small interest non-op owner

SUBSEQUENT WELLS NOT UNDER INFILL WELL PROVISION
56
EXISTING WELLS
57
- Go to this provision (19.15.16.15(A)(11)) when there is an
existing well in the same pool and within same boundaries
- f proposed HSU.
- Designed to protect owners in existing wells from adverse
impacts from a new well being in close proximity.
- Existing owners offered opportunity to participate in
proposed horizontal well.
SUBSEQUENT WELLS
58
- Subject to an OA or pooling order:
- A subsequent well partially in an existing SU may be drilled
with approval of all operators and WIOs in existing and new spacing units or after pooling.
- A subsequent well wholly within existing SU, if not
designated as an infill well, may be drilled with approval of all operators and WIOs in existing and new spacing units or after pooling.
59
OTHER MATTERS
60
- Directional survey requirements are the same.
- Downhole commingling change: If a wellbore goes from one
pool to another pool in the same formation, no DHC necessary.
- Conflicts with existing rules/orders: Except for the Purple
Sage-Wolfcamp Gas Pool, existing rules/orders that conflict with new rules, do not apply. Special Pool Rules adopted after these rules will prevail.
- Transitional provisions: All Project Areas or NSPs are now
standard or non-standard spacing units.
