Commission Staff Review Certification Background Check “Hits” Investigate Complaints If evidence warrants: Staff prepares accusation and attempts mutually agreed resolution (sanction must be accepted by commission in formal meeting). If evidence does NOT warrant: Dismiss (Complainant may appeal for an administrative review by Commission.) Partners with Department of Law to present cases to the Commission

Causes for
 Suspension or Revocation

AS 14.20.030 (a) The Commissioner or the Professional Teaching Practices Commission may revoke or suspend a certificate for the following reasons: (1) Incompetency, which is defined as the inability or the unintentional or intentional failure to perform the teacher’s customary teaching duties in a satisfactory manner; (2) Immorality, which is defined as the commission of an act which , under the laws

  • f the state constitutes a crime involving moral turpitude;

(3) Substantial noncompliance with the laws of the state or the regulations of the department; or (4) upon the determination by the Professional Teaching Practices Commission that there has been a violation of ethical or professional standards or contractual

  • bligations.

Breach of Contract

PROCEDURES OF PTPC ON BREACH OF CONTRACT DUE TO UNILATERAL TERMINATION BY AN EMPLOYEE

  • A. An educator under contract with a school district who fails to give

written notice of intent to terminate the contract, or who leaves the position following such notice without having the written assent of the employer, shall be deemed to have breached the contract and may be subject to disciplinary action including possible revocation of certificates by the PTPC.

  • B. If the unilateral termination by the educator occurs after June 30th,

without persuasive mitigating circumstances, such a violation will result in a minimum one-year suspension of the educator’s certificate.
